and its implications. .. For some years the 'Texas Commission has
been engaged in experimental endeavor to devise appropriate for-
mulas for a fair allotment of the allowable production. The commit-
ment of such a delicate task to the administrative process has not
escaped challenge in the courts, and at times the challenge has been
successful. . But such cases are only episodes in the evolution of
adjustment among private interests and in the reconciliation of all
these private interests with the underlying public interest in such a
vital source of energy for our day as oil.
The validity of the proration order was upheld with the conse-
quent recognition of a broad area of discretion possessed by the
commission.
In this complicated field numerous orders of the commission
have been challenged in the courts, some of them successfully.
The accounts of litigation and judicial opinions relating to reg-
ulatory measures occupy shelves of books and reports. It seems
that as long as oil and gas are produced in 'Texas and subject to a
high degree of regulation, litigation will be a necessary concomi-
tance. After all, oil and gas are important to Texas. The statistics
on known petroleum reserves in the United States as contained
in the 1963 report of the Oil and Gas Division of the Railroad
Commission are impressive. The total estimated reserves of the
country were 30,969,990,000 barrels. Of that, almost half, 47.06
per cent, is in Texas, which is followed by Louisiana with 16.43
per cent; California, 11.62 per cent; Oklahoma, 5.26 per cent;
Wyoming, 4.05 per cent; Kansas, 2.72 per cent; and all other
states, 12.86 per cent.
