The passing of the law department simply complicated difficult times
which already plagued Austin College. The financial condition of the
college, which had never been secure, was precarious as long as the
institution was located in Huntsville, and the enrollment remained
small. The Civil War left the area emotionally exhausted and com-
pounded existing problems. The instructional program at the college
was interrupted only briefly during the war, but the effort required for
the old school simply to survive in the postwar era was of such magni-
tude that no further consideration was given to a law department. The
disastrous yellow-fever epidemic of 1867 took a costly toll in lives at
Huntsville. Then, in 1871, the Houston and Great Northern Railroad
built its main line seven miles to the east of town. Community leaders

1978, interview. The degrees granted at Austin College in 1854 are the first associated with
a Texas college which has remained in operation under its original charter. Rutersville
College, which was chartered in 1840, granted bachelor's degrees contemporaneous with
those issued by Austin College, but later Rutersville College was consolidated with three
other Methodist institutions to form Southwestern University, which was chartered in 1875.
