Senate votes to disqualify Duvall
The Students' Association voted 18-14
Monday in favor of a special election for
the office of president in which Darren
Duvall cannot run. The proposal was
floored by SA president Lance McAlister.
About 120 non-Senate members attend-
ed Monday's meeting most of whom
voiced support of a proposal that Duvall
be allowed another chance to run for SA
president.
SA vice president Kim Couch read the
findings of the Election Committee which
met Friday and Sunday to discuss election
violations by Duvall. A complaint charg-
ed Duvall with violating and election pol-
icy rule prohibiting campaign expenses
from exceeding $ 100.
The Election Committee consisting of
sue people voted Sunday 4-1 with one ab-
sent that Duvall was guilty of the violati-
ons. The committee also voted unani-
mously that Duvall be allowed to run in a
special election for S A president.

would automatically disqualify him.

the committee did not understand
wliat the results of its actions would
be. She also said the committee did
not fully understand the Election
Committee review procedure.
"Kim Couch told us we had to
decide both if he had violated the
rules and if he should be allowed to
run in the next election" Hunter
said. "Lance McAlister later called
us and said the disqualification
decision immediately kept him from
running in a second election.
"Had I known that before wc
made our decision I might have
voted differently" she said.

said the committee had no knowl-
edge of the constitution.
Couch disagreed and said she ex-
plained to the six-member commit-
tee exactly what they were expected
to do and $ they knew they were not
the final 'say on whether Duvall
could run again.
McAlister explained that Monday's
meeting was not called to decide Duvall's
guilt or innocence but to decide whether
Duvall should be allowed to run in the
special election.
McAlister called for a special election
for SA president in which Duvall could
not run and then opened to floor for
statements and questions to voting
senate members first and then to students.
SA treasurer Mike Carr who lost the
presidential election to Duvall admitted
he violated election rules and vowed he
would not run in any special election.
However he supported not allowing
Duvall to run in a special election.
Duvall said the vote was disappointing
and he did not believe the Senate was ser-
ving the interests of the student body. He
said he endured a lot since he was first
declared SA president.
"I wouldn't wish what happened to me
on anyone else" he said.
The majority of the two-hour long
meeting was taken up with students voic-
ing support of Duvall or support of the
proposal on the floor.
A number of the students who attended
said Monday was the first time they had
seen an SA Senate meeting. Many said
they attended the meeting to be sure that
justice was served.
"It appears to be a constitutional vio-
lation for the Senate to be dealing with
this subject" said Wallis Hampton
senior history major from Coeur d' Alcne
Idaho and a Duvall supporter. "The
bylaws clearly indicate that this is a power
of the Election Committee."
Others said they attended just for the
show.
The special election date has not been
determined yet but McAlister said it will
be a completely new election and can-
didates will have to go through the nor-
mal election process.
How the SA Senate voted
The SA Senate approved 18-14 a special election called by president
Lance McAlister for the office of SA president In which Darren Duvall
could not run. A vote of "Yes" is a vote not to allow Duvall to run In a
special election. A vote of "No" is a vote not to have the special election
in which Duvall was disqualified. The individual votes were:

-'An- investigation into'the Students'
Association presidential elections
began with a formal complaint
against Darren Duvall filed by
Robert I. Lyles sophomore fetology
major from Pleasant View Utah.
The letter was filed April 13 with
Kim Couch SA vice president and
chairman of the Election Commit-
tee. Mike Carr current SA treasurer
and a former candidate for the
presidency said "Rob Said he
would like to be the one to file it."
The complaint was addressed to
the committee chairman and reads:
"In keeping with Section I of the
1989 Students' Association election
policy and SA constitution bylaws
Section 3-A I Robert I. Lyles
formally petition the SA Election
Committee to investigate the alleged
breach of the 1989 SA Election pol-
icy Section 5 letters H and I which
state "The campaign expenses of
executive officer candidates shall
not exceed $100. Receipts for all
campaign material must be made
available to the Election Committee
upon request.
"1 allege that candidate Darren
Duvall: 1) met the predescribed
limit of $100 in his campaign costs
at the ACU Copy Center and 2) ex-
ceeded that limit by accepting the

Police investigate shooting

The Abilene Police Department is
investigating an apparent accidental
shooting that occurred Saturday
moming in Smith-Adams Hall.
Randall Lane Porter junior in-
ternational studies major from San
Antonio sustained a single "clean

"Right now we're treating it as an
accidental gunshot wound" Dieken
said.

himself was alone in the room at
the time of the shooting he said.

changed his story when police arrived.

pital and traveled to Lubbock to be

Elections for class officers were
conducted Monday and the results
were tabulated by about 9:30 p.m.
