ARTICLE IV.-EXECUTIVE DEPARTMENT

Sec 4. Governor When Installed; Term;
Qualifcations.-The Go e nor shall be in-
stalled on the first Tuesday after the gani
zaton of the Legislature or as soon thee-
after as practicable, and shall hold his office
for the term of two years, or until his suc-
cessor shall be duly installed He shall be at
least 30 years of age a citizen of the United
States, and shall have resided in this State
at least five years immediately preceding his
electron
Sec 5. Governor's Salary and Mansion.-
The Governor shall, at stated times, receive
as compensation for his services an annual
salary of $12,000 and no more, and shall hate
the use and occupation of the Governor's
Mansion, fixtures and furniture, provided
that the amendment shall not become effec-
tive until the t hird Tuesday in January,
1937
[Note-The foregoing Sec 5 of Art IV was
amended to raise Governor's salar, from 000

See. 6 Governor to Hold No Other Office,
Etc.-During the time he holds the office of
Governor he shall not hold any other office
practice any profession and receive compen-
sation, reward, fee or the promise thereof
civil, military or corporate, nor shall he
for the same, nor receive any salary, retard
or compensation or the promise thereof from
any person or cor poi atron for any service
rendered or per for med during the time he is
Governor or to be thereafter render ed or
performed
Sec 7 Commander in Chief; May Call Out
Militia.-He shall be r ommandei in ih cf of

the military forces of the State, except when
they are called into actual service of the
United States He shall hate power to call
forth the militia to execute the laws of the
State. to suppress insurections. repel Inva-
sions and protect the frontier from hostile
incursions by Indians o other predatory
bands
Sec 8 Governor May Convene Legisla-
ture -The Go r nor mav, on extraordlnai y
occasions, conene the Legislature at the seat
of goleinment o at a different place in case
that should be in possession of the public
enemy, of in case of the prevalence of dis-
ease thereat His proclamation therefor shall
state specifically the purpose for which the
Legislature is convened
Sec. 9. Governor's Message; to Account for
Moneys; Present Esti mates, Etc.-The Go-
ernor shall at the commencement of each
session of the Legislature, and at the close sf
his terms of office, glve to the Legislatur e
information, by message, of the condition if
the State, and he shall recommend to the
Legislature such measures as he may deem
expedient He shall account to the Legisla-
ture for all public moneys received and paid
out by him from any funds subject to his
order, mtth soucheos, and shall accompany
his message with a statement of the same
And at the commencement of each regular
session he shall present estimates of the
amount of money required to be raised by
taxatrn for all purposes
Sec 10 Governor Shall Cause the Laws to
Be Executed; Intercourse With Other States.
-He shall catse the laws to be faithfully
executed and shall conduct, in person, or in
such manner as shall be prescribed by law
all intercourse and business of the State with
other States and with the United States
Sec 11 There is hereby created a Board
of Pardons and Paroles, to be composed of
three members, who shall hae been resident
ctizens of the State of Teas for a period of
not less than two years immediately preced-
ing such appointment, each of whom shall
hold office for a term of six years, provided.
that of the members of the first board ap-
pointed, one shall sere for two years, one
for four years and one for six years from the
first day of February, 1937, and they shall
cast lots for their respective terms. One mem-
bher of said board shall be appointed by the
Governor, one member by the Chief Justice
of the Supreme Court of the State of Texas,
and one member by the presiding Justice of
the Court of Criminal Appeals, the appoint-
ments of all members of said board shall be
made with the advice and consent of two
thirds of the Senate present. Each vacancy
shall be filled by the respective appointing
power that theretofore made the appointment
to such position and the appoint ve powers
shall have the authority to make recess ap-
pointments until the convening of the Senate
In all criminal cases, except treason and
impeachment, the Governor shall have power,
after conviction, on the written signed rec-
ommendation and ad, ice of the Board of
Pardons and Paroles, or a majority thereof,
to grant reprieves, commutations of punish-
ment and pardons, and under such rules as
the Legislature may prescribe, and upon the
written recommendation and advice of a ma-
jority of the Board of Pardons and Paroles.
he shall have the power to remit fines and
forfeitures The Governor shall have the
power to grant one reprieve in any capital
case for a period not to exceed thirty (30)
day s, and he shall have the power to revoke
paroles and conditional pardons. With the
adv ice and consent of the Legislature, he may
grant reprieves, commutations of punishment
and pardons in cases of treason.
The Legislature shall have power to regu-
late procedure before the Board of Pardons
and Paroles and shall require it to keep rec-
