A HISTORY OF TYLER AND SMITH COUNTY, TEXAS
plead and be impleaded, and to hold and dispose of real and per-
sonal property; provided such real property is situated within the
limits of said corporation." Section II - "Be it further enacted
that it shall be the duty of the citizens of said corporation to
elect a Mayor, eight Aldermen, a Collector and Constable, and
a Treasurer and Secretary shall be selected by said Aldermen
from their own body; the Treasurer and Collector being re-
quired to give bond with security. The Mayor shall have power
when necessary to suppress riots and disturbances and to call
out the citizens of said corporation for the purpose of restor-
ing order."
Section VI - "Be it further enacted that the limits of said cor-
poration shall extend over one Hundred acres of land in a
square, laid off so as to leave the public square in the center
of said corporate limits."

This Act did not give the name of the surveyor who should
survey, or run the lines of the one Hundred acres of the cor-
poration of Tyler. This one Hundred acres, however, was later
subdivided into twenty-eight blocks by the surveyor, James C.
Hill.
Smith County Named in Honor of a Distinguished General
in the Army of the Republic of Texas.
SMITH County was named in honor of Gen-
eral James Smith, born in Spartanburg District, South Carolina,
on September 10, 1792, who at the age of twenty volunteered
for service in the army of the United States and served under
the command of General Jackson in 1812 in the battle of New
Orleans.
In the year 1816 he was married to Hannah Parker, and in
1834 came to Texas. In the following year his wife and family
joined him, and in 1836 they settled in Nacogdoches.
Realizing that a war with Mexico was impending, and that
urgent help was needed, in an early month of 1836 he went
to Tennessee and raised volunteers from that state and also
from Alabama, and brought this company to Texas to fight for
Texas freedom. It has been said that he spent his own money for
arms and ammunition for his men and for their subsistence and
