Chapter 1210 1 AN ACT 2 relating to certain standards for group-administered achievement 3 tests used by school districts. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1. Section 39.032, Education Code, is amended by 6 amending Subsection (c) and adding Subsections (c-1) and (c-2) to 7 read as follows: 8 (c) State and national norms of averages shall be computed 9 using data that are not more than eight [ i] years old at the time 10 the assessment instrument is administered and that are 11 representative of the group of students to whom the assessment 12 instrument is administered. 13 (c-l) The standardization norms computed under Subsection 14 (c) shall be: 15 (1) based on a national probability sample that meets
16 accepted standards for educational and psychological testing; and 17 (2) [shall be] updated at least every eight [e -i] 18 years using proven psychometric procedures approved by the State 19 Board of Education. 20 (c-2) The eight-year limitation on data to compute norms 21 under this section does not apply if only data older than eight 22 years is available for an assessment instrument. The commissioner 23 by rule may limit the exception created by this subsection based on 24 the type of assessment instrument.
