NOTICE OF AN APPLICATION TO
APPROPRIATE PUBLIC WATERS OF
THE STATE OF TEXAS
Notice is given that City of Rusk and
Betty J. McLain c/o City of Rusk 408 N.
Main Street Rusk, Texas 75785 appli-
cants, request an extension of time pur-
suant to S11.145, Texas Water Code,
and Texas Water Commission Rules 31
TAC SS295.1, et seq. to complete modi-
fications of Rusk Ore Mine Dam author-
ized under Certificate No. 06-3302.
Certificate of Adjudication No. 06-3302,
owned by the City of Rusk and Betty J.
McLain, was issued on February 7,1985
and authorizes certificate owners to
maintain Rusk Ore Mine Dam and reser-
voir on Mall Creek, tributary of Bean's
Creek, tributary of Box Creek, tributary of
the Neches River, Neches River Basin
and impound therein not to exceed 345
acre-feet of water for recreational pur-
poses, approximately 2.5 miles north-
west of Rusk, Cherokee County, Texas.
A Commission Order dated April 14,
1988 extended the current date to com-
plete the modifications required by Cer-
tificate No. 06-3302 until November 26,
1989. Applicants are requesting another
two year extension of time until Novem-
ber 26,1991 for completion of the modi-
fications due toflooding in the area during
March of 1989. Also, the Texas Parks
and Wildlife Department, which holds a
50 year lease, required additional work
on the plans and is presently preparing to
go to bid. The applicants think that the
two year extension will insure a reason-
able opportunity to determine and effec-
tuate the most appropriate method to
complete repairs.
The request for Extension of Time was
received on November 3, 1989, and
accepted forf Hing on November 17,1989.
The Executive Director has reviewed this
application and declares it to be adminis-
tratively complete.
No public hearing will be held on this
application unless a person that may be
affected requests a public hearing. Any
such request must be in writing and
contain (1) the name, mailing address
and telephone number of the requester;
(2) the application number or other rec-
ognizable reference to this application;
(3) a brief explanation of how the re-
quester, or persons represented by the
requester would be adversely impacted
by the granting of this application; and (4)
a clear statement of the objections of the
requester or represented persons.
This application will be presented to
the Commission for final decision on
Í 31,1990 at 9 a.m. in Room 118
of the Stephen F. Austin State Office
íg, 1700 N. Congress Avenue,
Austin, Texas unless a sufficient request
for hearing is received within 30 days of
the date of newspaper publication of this
notice. If a hearing request is filed, and
the Commission determines that the
request sets out an issue relevant to the
decision on the application, and/or that a
public hearing would serve the public
interest, the Commission will remand the
application for public hearing. If this
application is remanded for hearing, no
further notice of the hearing or hearing
date will be issued other than advising all
interested persons of the time and place
where the hearing is to convene. There-
fore, all individuals who wish to be noti-
fied of the setting of a hearing must sub-
mit a written request for notification to the
Texas Water Commission.
