90 SPECIAL LAWS.
SEC. 6 That the board of trustees of the Schwertner Independent
School District shall consist of three members and they each shall'
be resident citizens and qualified' voters of the said district, and
each member of the said board of trustees shall, before entering upon
h;s duties, make oath that he will faithfully and impartially discharge
the duties of such office, and' said oath shall be filed with
the president of the said board of trustees; provided, however, that
the board of trustees heretofore elected for and in behalf of the
Schwertner Common School District No. 48, of Williamson County,
Texas, shall be and constitute the board of trustees for this district,
till their successors are elected and qualified.
SEC. 7. That on the first Saturday in April after this Act shall
take effect, an election shall be held, and three trustees elected, and
two of those so elected shall hold office for one year and the third
one so elected, shall hold office for two years, and that each year
thereafter, their successors shall be elected. All trustees to hold
office till their successors are elected and qualified.
SEC. 8. The board of trustees of the Schwertner Independent
School District shall be a body corporate in law, and as such may
contract and be contracted with and may sue and be sued, plead
or be impleaded in any court of this State of proper jurisdiction,
and may receive any grants, donations or devises for the use and
benefit of the public free schools in the said district.
SEO. 9. The board' of trustees of the Schwertner Independent
School District, shall manage and control the public free schools in
the said district to the exclusion of every other authority, except,
in so far as the State Superintendent of Public Instruction and the
State Board of Education may be vested with supervisory authority,
under the General Law.
SEC. 10. Vacancies on the board of trustees shall be filled for
the unexpired term, by a vote of a majority of the members continuing
in office.
SEC. 11. A majority of the board of trustees shall constitute a
quorum to do business. From their number they shall choose a
president, secretary, treasurer, or any other officers or committees
that the board in its judgment may deem necessary. If they see fit,
they may vest the authority of two or more of these offices in the
same person. The treasurer shall be required to give bond in such
amount as may be fixed by the board of trustees. Such bond shall
be payable to the board of trustees and their successors in office,
and shall be approved by them, conditioned upon the faithful performance
of his duties, and that he safely keep and properly pay
out, all moneys coming into his possession. The treasurer shall
receive such commissions as the board' may allow, not however, to
exceed one per cent of the funds coming into his possession.
SEC. 12. The officers appointed by the board may be discharged
by the board, at any time, for cause that may seem proper to the
board; but no officer shall be so discharged without a chance of
being heard before the board.
SEC. 13. That the board, if it deem proper, may appoint some
person, or persons, other than a member of the board to the offices
of treasurer and assessor and collector, and may also appoint some
