CHAPTER 216 H.B. No. 174 1 AN ACT 2 relating to benefits for members of the state military forces 3 called to active state duty. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1. Subchapter A, Chapter 431, Government Code, is 6 amended by adding Section 431.017 to read as follows: 7 Sec. 431.017. CERTAIN BENEFITS AND PROTECTIONS FOR STATE 8 SERVICE. A member of the state military forces who is ordered to 9 active state duty by the governor or by other proper authority under 10 the law of this state is entitled to the same benefits and 11 protections provided: 12 (1) to persons performing service in the uniformed 13 services by 38 U.S.C. Sections 4301-4313 and 4316-4319, as that law 14 existed on April 1, 2003; and 15 (2) to persons in the military service of the United 16 States by 50 App. U.S.C. Sections 501-536, 560, and 580-594, as that 17 law existed on April 1, 2003. 18 SECTION 2. This Act applies only to persons serving on 19 active state duty on or after the effective date of this Act without 20 regard to the date on which the person was. initially ordered to 21 active state duty. 22 SECTION 3. This Act takes effect immediately if it receives 23 a vote of two-thirds of all the members elected to each house, as 24 provided by Section 39, Article III, Texas Constitution. If this
