CHAPTER 636 H.B. No. 2075
1 AN ACT
2 relating to regulating health and safety conditions at youth camps.
3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
4 SECTION 1. Section 141.007, Health and Safety Code, is
5 amended by adding Subsections (d), (e), (f), and (g) to read as
6 follows:
7 (d) An employee or agent of the department who enters a
8 youth camp to investigate and inspect conditions shall:
9 (1) notify the person in charge of the camp or the
10 person's designee of any violations as they are discovered; and
11 (2) allow the camp to correct the violations while the
12 investigation and inspection is occurring.
13 (e) The department may not extend or delay an investigation
14 or inspection to allow the youth camp to correct a violation under
15 Subsection (d)(2).
16 (f) An employee or agent of the department performing an
17 investigation and inspection under this section may not report a
18 violation that is significant under the department's rules if the
19 violation is corrected during the investigation and inspection.
20 (q) A penalty may not be imposed on a youth camp for a
21 violation that is significant under the department's rules if the
22 violation is corrected during an investigation and inspection under
23 this section.
