CHAPTER 1118 H.B. No. 2567 1 AN ACT 2 relating to the disposal of brine from desalination operations. 3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 4 SECTION 1. Subchapter B, Chapter 27, Water Code, is amended 5 by adding Section 27.021 to read as follows: 6 Sec. 27.021. PERMIT FOR DISPOSAL OF BRINE FROM DESALINATION 7 OPERATIONS IN CLASS I WELLS. (a) The commission may issue a permit 8 to dispose of brine produced by a desalination operation in a Class 9 I injection well if the applicant for the permit meets all the 10 statutory and regulatory requirements for the issuance of a permit 11 for a Class I injection well. " 12 (b) The commission by rule shall provide for public notice 13 and comment on an application for a permit authorized by this 14 section. Notwithstanding Section 27.018, an application for a 15 permit authorized by this section is not subject to the hearing 16 requirements of Chapter 2001, Government Code. 17 SECTION 2. This Act takes effect September 1, 2003.
