CREATING THE 114TH JUDICIAL DISTRICT COURT.
S. B. No. 11.] CHAPTER 81.
An Act to create the 114th Judicial District of Texas and to give such
Court concurrent jurisdiction with the District Court of Gray County,
Texas, in and for the 31st Judicial District of Texas, and concurrent
jurisdiction with the District Court of Hutchinson and Carson Counties,
in and for the 84th Judicial District of Texas, in all civil and
criminal cases; to provide a clerk for said courts and the transfer to
said 114th District Court of certain cases now pending in the 31st
Judicial District Court in and for Gray County, Texas, and the 84th
Judicial District Court in and for Hutchinson and Carson Counties,
Texas; to designate the character of cases to be filed in said court after
its organization; the manner of filing and numbering suits in both of
said courts, in said counties, of Gray, Hutchinson, and Carson, and keeping
file dockets therein; to provide that the respective sheriffs and other
officers of said counties of Gray, Hutclinson and Carson shall perform
certain duties with reference to said court, and for the appointment of
a shorthand reporter for said court; to provide that the District Attorney
of the 31st Judicial District shall, in addition to his present
duties, prosecute all criminal cases in said court and represent the
State in all cases therein where the State is a party, in said County of
Gray; and that the District Attorney of the 84th Judicial District shall.
in addition to his present duties, prosecute all criminal cases in said
court and represent the State in all cases therein where the State is a
party, in said counties of Hutchinson and Carson; to provide that all
process and writs issued or served and recognizances, bonds and undertakings
entered into before this Act takes effect and made returnable
to either the 31st Judicial District Court or the 84th Judicial District
Court, and all jurors drawn, shall, in cases that are transferred
to the 114th District Court be valid and considered as returnable to
the 114th District Court; to provide that the Judge of the 31st District
Court and the Judge of the 84th District Court, in said Counties
of Gray, Hutchinson and Carson, respectively, may, in their discretion,
in term time or vacation transfer cases from their respective courts to
the other of such courts, and the judge of either court may sit in such
other court to enter orders of transfer where the judge of said court
has certified his disqualification in any case; to provide for the appointment
of a Judge of the 114th District Court by the Governor of
this State; to declare the purpose of this act and if any section or part
thereof should be held unconstitutional that fact shall not affect the
validity of the other sections of this Act; to appropriate funds to pay
the Judge and the expenses of the Judge and official reporter; to repeal
all laws in conflict with this Act, and declare an emergency.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. The 114th Judicial District of Texas is hereby
created to be composed of the counties of Gray, Hutchinson and
Carson, in the State of Texas.
SEC. 2. The District Court hereby created shall have jurisdiction
over all matters, both civil and criminal, over which
the district courts of this State are given jurisdiction by the
Constitution and laws of this State, and shall have concurrent
jurisdiction in Gray County, Texas, with the District Court of
the 31st Judicial District in said Gray County, and shall have
concurrent jurisdiction in Hutchinson and Carson Counties with
the 84th Judicial District Court in said Hutchinson and Carson
