AMENDING CHILDRESS COUNTY ROAD LAW.
S. B. No. 65.] CHAPTER 1.
An Act to amend Section 2a and 2b of Chapter 28, of the Local and
Special Laws enacted by the 33rd Legislature at its Regular Session
in 1913, same being Special Road Law for Childress County, which
Sections 2a and 2b were added by Chapter 279 of the General and
Special Laws of the 41st Legislature at its Regular Session in 1929;
authorizing the Commissioners' Court of Childress County to issue
bonds (f said County for the purpose of funding or refunding indebtedness
incurred for Road and Bridge purposes and to levy a tax in
payment thereof, providing limitations upon the issuance of warrants
for Road and Bridge purposes, and exceptions therefrom; repealing
House Bill No. 86, passed at the Fourth Called Session of the 41st
Legislature; and declaring an emergency.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. That Sections 2a and 2b of Chapter 28, of the
Local and Special Laws enacted by the 33rd Legislature at its
Regular Session in 1913, same being Special Road Law for Childress
County, which Sections 2a and 2b were added by Chapter
279 of the General and Special Laws of the 41st Legislature
at its Regular Session in 1929, be and the same are hereby
amended, and shall read as follows:
Section 2a. The Commissioners' Court of Childress County
is authorized and empowered to fund any and all indebtedness
lawfully incurred for Road and Bridge purposes prior to January
1, 1930, and in addition thereto not to exceed the amount of
fifteen thousand ($15,000.00) dollars incurred prior to July 1,
1930, whether same be current, funding or simple contract
debts, and whether issued in the form of warrants or otherwise,
into bonds of Childress County, redeemable and payable in not
more than forty (40) years from date, and the same may mature
serially or otherwise as may be determined by the Commissioners'
Court, and may bear interest at the rate of not exceeding
five and one-half (51-%) per cent per annum, interest payable
annually or semi-annually as may be determined by said
Court. All such funding or refunding bonds shall be in such denomination
as may seem expedient and the Court shall provide
for the levy of an annual tax upon all property within the County
to provide for interest and sinking fund; providing that the aggregate
amount of bonds herein authorized shall not exceed the
limitations provided by the Constitution of Texas; and provided
further, that it shall not be necessary to submit the issuance of
4-Spec.
