RELATING TO ROAD DISTRICT NO. 2 OF CHEROKEE
COUNTY.
H. B. No. 53.] CHAPTER 2.
An Act to amend Section 1, Chapter 147, Acts 39th Legislature, First
Called Session, creating and defining by metes and bounds Road District
No. 2 of Cherokee County, Texas, under authority of Section 52,
of Article 3, of the Constitution of the State of Texas for the purpose
of constructing, maintaining and operating macadamized, graveled or
paved roads and turnpikes, or in aid thereof; providing that such
District shall be made a body corporate and taxing district under the
Constitution and laws of the State of Texas; excluding certain territory
heretofore embraced and contained within said District; providing
that the present outstanding bonds of said Road District No. 2
shall remain a charge against all of the taxable property situated
within said District as it existed at the date of the issuance of the
said present outstanding bonds; providing that the Commissioners'
Court of Cherokee County shall continue to levy, assess and collect
annually sufficient taxes to pay interest thereon and provide sinking
funds sufficient to pay the principal at maturity, said taxes to be
levied and collected upon all the property situated in said District as
it existed at the time of the issuance of the present outstanding bonds;
providing that said District as herein defined shall have authority to
issue bonds for the purpose of constructing, maintaining and operating
macadamized, graveled or paved roads and turnpikes, or in aid
thereof, upon a vote of two-thirds majority of the resident property
tax-payers voting thereon who are qualified electors of said District
as herein defined; providing for the levy and collection of taxes sufficient
to pay the interest on and provide sinking fund therefor, such
bonds and taxes to be a charge only against said District as herein
described and defined; and declaring an emergency.
Be it enacted by the Legislature of the State of Texas:
SECTION 1. That Section 1, Chapter 147, Acts of the 39th
Legislature, First Called Session, be and the same is hereby
amended so as to hereafter read as follows:
"Section 1. That Road District No. 2 of Cherokee County,
Texas, is hereby created and established as a defined road district
in the said County, under authority of Section 52, Article
3, of the Constitution of the State of Texas, for the purpose of
constructing, maintaining and operating macadamized, graveled
or paved roads and turnpikes, or in aid thereof, and such
District is hereby made a body corporate and taxing district
under the Constitution and laws of the State of Texas, with
metes and bounds as follows:
Beginning at a point on the Neches River immediately West
of the S. W. corner of the Christopher Edinberg Survey;
Thence E. 2815 vrs. with the S. lines of said Edinberg Survey,
M. Gilmore and most Southerly S. line of the Davis Strahand
Survey to the Northeast corner of John Ward Survey on W. B.
line of Lydia Webb Survey; Thence S. 430 vrs. with the most
Westerly line of said Webb Survey to most Westerly S. W.
corner of said Webb Survey; Thence E. 1413 vrs. with said
Webb Survey to N. E. corner of the M. Burns Survey, the same
