ment of any further costs that may be adjudged against it,
either in the Court below or upon appeal. The State, a county,
municipal corporation, irrigation district, water improvement
district or water power control district created under authority
of law, shall not be required to deposit a bond or the amount
equal to the award of damages by the Commissioners as provided
in Section 2 hereof."
SEC. 3. If any section, clause, provision or sentence of this
Act should ever be held to be unconstitutional, such holding
shall not affect the remaining portions of this Act, it being the
intention of the Legislature that effect shall be given to so
much of this Act as may be valid, even if a portion of this Act
should be held to be invalid.
SEC. 4. The fact that the present condemnation statutes do
not authorize irrigation districts, water improvement districts
or water power control districts organized under authority or
Act of the Legislature to condemn land, and the fact that many
of such districts are obtaining loans and grants of money from
the Federal government, and the further fact that it is imperative
that said district immediately condemn and obtain
possession of land in order to carry out the purposes for which
the grants and loans were made by the Federal government,
and the fact that said grants and lands will be lost unless land
can be condemned and obtained upon which irrigation and
other works are to be constructed, all create an emergency and
an imperative public necessity that the Constitutional Rule requiring
bills to be read on three several days be suspended, and
said Rule is so suspended, and this Act shall take effect and be
in force from and after its passage, and it is so enacted.
