GAME TRAP LAW FOR VAN ZANDT COUNTY.
H. B. No. 126.] CHAPTER 55.
An Act requiring any person using any trap or similar device to take
any of the birds or animals of this State, upon the private lands of
another person in Van Zandt County, to first obtain and have in his
possession a written permit; providing other necessary regulations
pertaining to the obtaining of such permit; providing that the failure
to have in possession such valid permit shall be prima facie evidence
of guilt; providing a suitable penalty for violation of any provisions
of this Act; providing that it shall be the duty of any peace officer
operating in any county affected by the provisions of this Act to enforce
the provisions of this Act; repealing all laws in conflict with
any provisions of this Act, in so far as they relate to Van Zandt
County; and declaring an emergency.
Be it enacted by the! Legislature of the State of Texas:
SECTION 1. It shall be unlawful to set any trap, snare, deadfall,
or any other device for taking any of the birds or animals
protected by the laws of this State on the private lands of another
person without first having obtained written permission from
the owner or authorized agent in charge of such lands to indulge
in such privileges for the period of time specified in such permit.
SEC. 2. Any person who attempts to indulge in any of the
privileges for which a permit is required in Section 1 of this Act,
without first having obtained and having in his possession, at
the time he indulges in such privileges, a valid permit, as required
by Section 1 of this Act,. or any person who attempts to
indulge in such privileges upon a forged or fraudulent permit,
shall be deemed guilty of a misdemeanor and upon conviction
shall be fined in a sum not less than Ten Dollars ($10) nor more
than Two Hundred Dollars ($200).
SEC. 3. Any person who is found setting a trap or other device
for taking birds or animals of this State on the private lands
of another person without having first obtained and having in
his possession the permit required by Section 1 of this Act, shall
be prima facie guilty of a violation of this Act.
SEC. 4. This Act shall apply only to the County of Van Zandt,
and all laws or parts of laws, in so far as they conflict with any
portion of this Act, in so far as they relate to Van Zandt County,
be and the same are hereby repealed.
SEC. 5. It shall be the duty of all officers operating in any
county to which this Act applies to enforce all provisions of this
Act.
SEC. 6. The importance of this legislation and the crowded
condition of the calendar create an emergency and imperative
public necessity that the Constitutional Rule requiring bills to be
read on three several days in each House be suspended, and said
