CONSERVATION AND RECLAMATION DISTRICT AND
REMITTING AD VALOREM TAXES IN COUNTIES
ADJACENT THERETO.
S. B. No. 3.] CHAPTER 368.
An Act to amend Chapter 3 of the Special and General Laws of the 4th
Called Session of the 43rd Legislature and to amend Section 3 of
Chapter 19; Acts of the Regular Session of the 44th Legislature to
aid the Brazos River Conservation and Reclamation District, a state
agency, in acquiring the necessary lands; leases, easements and/or
acquittances, proper structures, and reservoirs suitable for the control
of flood waters of the Brazos River watershed declared to be a
public calamity, granting and donating with certain limitations to
the District for a period of twenty years all of the State ad valorem
taxes in the following counties, viz: Austin County, Brazoria County,
Burleson County, Fort Bend County, Grimes County, Waller County,
Washington County, Brazos County, Milam County, and Robertson
County; said grant being contingent upon the receiving by said
District of a grant and/or loan and/or allotment from the United
States of America or others on or before January 1st, 1937, of a sum
reasonably sufficient to effect the purpose of this Act; authorizing the
District to issue negotiable bonds, and declaring certain things incidental
to said purposes; and by adding new sections, which provides
the method for issuing bonds; providing that the District shall not
mortgage or otherwise encumber any of the properties, other than its
revenues and that the District may sell any of its property under certain
conditions'; defining the word District and the word Board, Director
or the Board of Directors; providing a penalty for the misapplication
of the moneys thus donated, providing for the investment of available
funds, providing for a system of accounting, providing that said
tax diversion is based on 1934 valuation; provided that the Attorney
General shall have the right to meet with Commissioners' Court in
preparing assessments, and granting certain powers to the Board of
Directors; providing how the District may acquire lands, leases, easements,
properties and power and right of eminent domain; providing
that directors or attorneys may not be appointed or employed under
certain conditions, and declaring an emergency.
Be it enacted by the Legislature of the State of Texas:
That Chapter 3, Special and General Laws of the 4th Called
Session of the 43rd Legislature and Section 3 of Chapter 19,
General Laws of the 44th Legislature be amended, so as to read
as follows:
"SECTION 1. That for a period of twenty years or for such
portion of such period as may be required but not longer and
commencing with the fiscal year beginning September 1, 1935,
and contingent upon a loan and/or grant and/or allotment from
the United States of America of sufficient size to reasonably
insure the completion of the construction of such unit or units
of such coordinated and completed system of improvements of
control of the Brazos River and its tributaries and waters
thereof as may be approved by the Board of Water Engineers.
