Texas Department of Criminal Justice;
(2) during the service period, have provided direct patient
care to:
(A) Medicaid enrollees and CHIP enrollees, if the prac-
tice includes children, or
(B) Persons committed to a secure correctional facility
operated by or under contract with the Texas Youth Commission or
persons confined to a secure correctional facility operated by or under
contract with any division of the Texas Department of Criminal Justice
[CiHIP enrollees].

21.257. Application Ranking Criteria.
If there are not sufficient funds to award loan repayment assistance for
all eligible physicians whose applications are received by the stated
deadline, applications shall be ranked according to the following crite-
ria, in priority order:

(3) HPSA score for applicant practice location;[-]
(4) the first ten applications received each year from eligi-
ble physicians serving persons committed to a secure correctional facil-
ity operated by or under contract with the Texas Youth Commission or

SUBCHAPTER RR. TEXAS ARMED
SERVICES SCHOLARSHIP PROGRAM
19 TAC 21.2243
The Texas Higher Education Coordinating Board (Coordinating
Board) proposes amendments to 21.2243, concerning the
Texas Armed Services Scholarship Program. Specifically, the
proposed amendments would clarify the eligibility requirements
for non-freshman students receiving initial awards.
Mr. Dan Weaver, Assistant Commissioner for Business and Sup-
port Services, has determined that for each year of the first five
years the amendments are in effect, there will be no fiscal impli-
cations to state or local government as a result of enforcing or
administering the rule.
Mr. Weaver has also determined that for each year of the first
five years the amendments are in effect, the public benefit antic-
ipated as a result of this change will be that the rule will clarify
requirements for non-freshman students receiving initial awards.
There is no effect on small businesses. There are no anticipated
economic costs to persons who are required to comply with the
section as proposed. There is no impact on local employment.

for 30 days following publication of the proposal in the Texas
Register.
The amendments are proposed under the Texas Education
Code, 61.9774, which provides the Coordinating Board with
the authority to adopt rules for the administration of the Texas
Armed Services Scholarship Program.
The amendments affect Texas Education Code, 61.9771 -
61.9776.
21.2243. Requirements for Appointment by Elected Officials.
(a) - (b) (No change.)
(c) A selected student must meet two of the following four
academic criteria at the time of application:
(1) Is on track to graduate high school or graduated with
the Distinguished Achievement Program (DAP) or the International
Baccalaureate Program (IB);
(2) Has a current high school GPA of 3.0 or higher or grad-
uated with a high school GPA of 3.0 or higher;
(3) Achieved a college readiness score on the SAT (1590)
or ACT (23);
(4) Is currently ranked in the top one-third of the prospec-
tive high school graduating class or graduated in the top one-third of
the high school graduating class.
(d) A non-freshman student applying for an initial award must
meet the requirements set forth in 21.2246(1) and (3) of this title (re-
