When, however, the courts of the
states Ocelli tt? hold tluit they
were public corporation.-?, afid
therefore amendable to the legis-
latures of the states, they appeal-
ed to the federal courts, claiming
tirst, that they were private cor-
porations, and secondly, that if
thev were quasi-public corpora-
tions, the regulation of them
could only he had through the
federal congress. The courts
having sustained this view, the
people of the various states then
demanded that the congress
should pass such legislation and
create such boards of control as
were necessary to secure to the
people their just right- in the
matter, in obedience to tiji.- de-
mand congress, eleven years ago,
created that subterfuge for jus-
tice called the inter-state com-
merce commission and enacted
legislation that was supposed by
the people to be for the securing
their rights and controlling these
corporations. After eleven year-
of wcar) waiting the people are
now told by this commission, in
its tenth annual report just is-
-ued, that the law under wfeieb
they were acting was defective
and bad been held by the court
ot last resort a- inoperative and
unconstitutional.
"Thus, after !:fty years of ef-
fort in this direction we find that
practically nothing has been
done toward the control of cor-
porations; that the question has
lu-en avoided and delayed as
much as possible through the
courts, and tins-lly at the end we
iind the will of the people
thwarted and the corporations

••If the congress of the United
States pass an amended law the
torpid snake of litigation will
again begin to crawl slowly
drawing traffic in that direction,
and the decreased rate at which
the railroads would be compelled
to carry freight would be made
up in the yolutne of business.
The state of New York, by com-
pleting the Erie canal and keep-
ing the tolls at low rate, has
caused the commerce of the
country to flow in that direction,
good times and scas to make it the great commer-
ones are to be!c'a' metropolis uf the country,

the legislature should not pro-

revenge for the misdeeds of the
corporations in the past, but they
should make their purpose ele^r
to these corporations, that in the
future the interests of the citi-
zens of this state are to be taken
