nary examination on a charge of killing ala

at Alpine vesterdav. arrived In Hi Paso arsln
last night and was taken to the county
Jail. Justice Ragln or Alpine remanded him
to jail without bond to await the action or

Judge L. A. Dale of El Paso who has
been retained aa Spannelfa attorney has
given no intimation or wnat spanneirt de-
fense will be. Following the preliminary
hearing. Spannell handcuffed waa rushed
to a waiting automobile and driven to To-
rornta. a flag station all miles west or
Alpino wnere ne was placed aboard the
train bound for El Paso in charge or Sher-
iff Walton and deputy Shertrr Shoemaker.
Spannell showed the effects of the tier-
vous strain under which ht has been labor-
ing when be was brought Into the court-
room at Alpine. It waa believed he was
on the verge or a mental collapse. He sob-
bed a broken greeting to the rew officers
present and searched the courtroom with
bloodshot eyes. He paid little attention "to
the examination mumbling to himself "Oh
my little rtrl! My own little girl!" His
five-year old daughter as at the o me or
nef grandparnu during the bearing.
The examination waa perfunctory and
caused little excitement In Alpine. Be-
cause of the erroru which had been made
to keep Spsnnetl's presence In Alpine a

that the hearing was being held.
During the trip to Alpine and return and
at the hearing Spannell persisted In bis
