Texas Civil Statutes); and declar-
ing an emergency."

Municipal Water District; adding
Section la and amending Sections
3 (b) and 7 of Chapter 62, Acts of the
52nd Legislature, 1951 (Article 8280-
141, Vernon's Texas Civil Statutes);
and declaring an emergency."

Senator Hall offered the following
Committee Amendment to the bill:
Amend House Bill 972 by renum-
bering the present Section 4 to "Sec.
5." and adding a new Section 4 read-
ing as follows:
"Sec. 4. Chapter 62, Acts of the
52nd Legislature, 1951 (Article 8280-
141, Vernon's Texas Civil Statutes),
is amended by adding subsection (b)
to Section 8, reading as follows: 'Sec.
8(b) In the event that the District,
in the exercise of the power of em-
inent domain or police power, or any
other power granted hereunder,
makes necessary the relocation, rais-
ing, lowering, rerouting, or changing
the grade of, or altering the construc-
tion of any railroad, electric trans-
mission, telegraph or telephone lines,
properties and facilities, or pipeline,
all such relocation, raising, lowering
rerouting, changing of grade or al-
teration of construction shall be ac-
complished at the sole expense of the
District. The term 'sole expense' shall
mean the actual cost of such reloca-
tion, raising, lowering, rerouting, or
change in grade or alteration of con-
struction in providing comparable re-
placement without enhancement of
such facilities, after deducting there-
from the net salvage value derived
from the old facility."1820
