The State Board of Insurance proposes

Carroll Fuch',, chief of staff services, has
determined that for the first five-year pe-
riod the proposed section will be in effect
there will be -o fiscal implications for
state or local government as a result of
enforcing or administering the section
There is no anticipate; economic cost to
small businesses other than what is spe-
cified in this notice for all persons re-
quired to comply with the section. There
is no difference in the rate of assessment
between large and small businesses.
Mr. Fuchs also has determined that for
each year of the first five years the sec-
tion is in effect the public benefit antici-
pated as a result of enforcing the section
will be the promulgation of a rate which
will facilitate the proper collection of
maintenance taxes to maintain the State
Board of Insurance, and the anticipated
possible economic cost to persons who
are required to comply with the proposed
section will be payment of the tax at the
rate specified. The arnount of tax will de-pend on the type and amount of insur-
ance written.
Comments on the proposal may be sub-
mitted to Nicholas Murphy, Chief Clerk,
State Board of Insurance, 1110 San Jacin-
to Boulevard, Austin, Texas 78701-1998.
The new section is proposed under the In-
surance Code, Texas Civil Statutes, Articles
5.12, 5.24, 5.49, 5.68, 9.46, and 23.08, which
provides the State Board of Insurance
with the authority to assess maintenance
taxes for the lines of insurance specified
in these sections.
1.405. Assessment of Maintenance Tax,
1987. The following rates for maintenance
taxes are assessed on gross premiums for the
calendar year 1986 for the hnes of insurance
specified.
(1) For automlobile msmuance, put-
suant to the Insurance ('ode, Article 3.12,
the rate is .019 of 1 0%.
(2) For casualty and fidelity insur-
ance, guaranty and surety bond, pursuant
to the Insurance Code, Article 5.24, the rate
is .027 of 1.0%/o
(3) For fue insurance and allied
lines, including inland marine, pursuant to
the Insurance ('ode. Article 5.49, the rate is
.523 of 1.0%.
(4) For workers' compensation in-
surance, pursuant to the insurance Code,
Article 5.68, the rate -, .361 oif 1.(0'%
(5) For title insurance, pursuant tc
the Insurance ('ode, Article 9.46, the rate I,

(6) For prepaid legal series, pur
suant to the Insurance Code, Article 23.08,

Periodic Screening,
Diagnosis, and Treatment

1 he Texas Department of Human Services
proposes the repeal of 933.1, 33.31, 33.62,
33.64, 33 65, 33133, 33.135. 33.137, 33.138,
33.228, and 33 309, concerning the Early
and Periodic Screening, Diagnosis, and
Treatment (EPSDT) Program. The repealed
sections are either obsolete or contain po-
licies that are included in other sections.
New sections and amendments are pro-
posed in this issue of the Texas Register
to clarify and update policies regarding
the delivery and receipt of EPSDT services.
The department is not making substan-
tive changes in the program or its policies,
but is ensuring that the sections governing
the program are current
Brian Packard, associate commissioner
for budget, planning, and economic anal-
ysis, has deterrined that for the first five
year period the repeals will be in effect,
there will be no fiscal !rnplications for
state or local government or small busi-
nesses as a result of enforcing or admin-
istering the repeals
Mr Packard also has determined that for
each year of the first five years the repeals
are in effect, the public benefit anticipated
as a result of crnforcing the repeals will
be more effective administraton of the
EPSDT Program as a result of having rules
that are consister.t with tre service deli-
very system an the handbooks that sup-
port this system There is no anticipated
economic cost to individuals who are re-
quired to comply with the proposed re-
peals.
