Definitions 348.05.01
The Governor's Committee on Aging proposes to adopt Rule
348.05.01.001 which establishes procedures for designation
of area agencies on aging and planning and service areas.
Procedures for submitting application and criteria for desig-
nation are included. Withdrawal of area agency designation
is also explained.
The Governor's Committee on Aging does not anticipate the
proposed rule will have state or local fiscal implications.

This rule is proposed under authority of the Human
Resources Code. Chapter 101.
.001 De/initions
(a) Act-Is the Older Americans Act (42 United States
Code Section 3001. et seq.).
(b) Area agency-Is the agency designated by commit-
tee in a planning and service area to develop and administer
the area plan for a comprehensive and coordinated system of
services for older persons.
(c) Area plan-Is the document submitted by an area
agency. to committee in order to receive grants or contracts
from committee.
(d) Committee-Is the Governor's Committee on
Aging. the single state agency designated to develop and ad-
minister the state plan and be the focal point on aging in the
State of Texas.
(e) Greatest economic need-Means the need resulting
from an income level at or below the proverty threshold es-
tablished by the Bureau of the Census.
(f) Greatest social need-Means the need caused by
noneconomic factors which include physical and mental dis-
abilities, language barriers, cultural or social isolation, in-
cluding that caused by racial str tn:c latus (for example,
Black, Hispanic, American Indian. and As.ian American).
which restrict an individual's ability to perform normal daily
tasks or which threaten his or her capacity to live indepen-
dently.
(g) Indian tribal organization-Means the recognized
governing body of any Indian tribe, or any legally established
organization of Indians which is controlled, sanctioned, or
chartered by the governing body.
(h) Indian tribe-Means any tribe, band, nation, or
other organized group or community of Indians (includingany Alaska Native Village or regional village corporation as
defined in or established under the Alaska Native Claims
Settlement Act, Public Law 92-203. 83 Statute 688) which is
recognized as eligible for the special programs and services
provided by the United Slates to Indians because of their
status as Indians; or is located on, or in proximity to a federal
or state reservation or rancheria.
(i) Planning and service area-Means a geographic
area of a state that is designated for purposes of planning,
development, delivery, and overall administration of services
under an area plan.
(j) Reservation-Means any federally or state recog-
nized Indian tribe's reservation. pueblo, or colony, including
former reservations in Oklahoma. Alaskan Native regions es-
tablished pursuant to the Alaska Native Claims Settlement
Act (85 Statute 688). and Indian allotments.
ik) State plan-Is the document submitted by a state in
order to receive grants from its allotments under this part.
(1) State regional planning area-Is a political subdivi-
sion of the state, the general purpose of which is to make
studies and plans to guide the unified, far-reaching develop-
ment of the area, to r minate duplication, and to promote
economy and efficiency in the coordinated development of
the area.
