The 1961 edition of Vernon's Texas Penal Code contains 36
pages of small print citations to these local laws. The 1961 and
1963 sessions of the Texas Legislature resulted in the addition
of five more pages of similar citations, and 49 of the bills enacted
by the Regular Session of the 59th Legislature in 1965 will
receive this treatment.
In this book, the obsolete or repealed portions of such local
laws have been deleted and an effort has been made to present
only the game and fish laws which actually are in effect at the
present time.
The last decade has seen the Texas Legislature enact many
laws placing responsibility for regulating open seasons, bag
limits, and means and methods of taking wildlife resources in
the Parks and Wildlife Commission and its predecessors.
Such laws, while adding the important new dimension of
flexibility to wildlife law, have increasingly frustrated the
users of the Game and Fish Laws, since they tell merely how
the regulations are to be enacted, but not what the regulations
actually are. This problem is being dealt with by the addition
to this edition of a supplement, which is designed to fit into
the pocket inside the back cover of this book. Each October,
as the last of the new season regulations are enacted, they will
be printed and distributed to the users of this volume.
Article 905 of the Penal Code establishes the authority of
game wardens as ". . . the same power and authority as sheriffs
to serve criminal processes in connection with cases growing
out of the violations of this chapter. . . ." As the reader can
see, "this chapter" serves as the limit of laws which are en-
forceable by game wardens, in the absence of special authority
contained in other statutes.
The chapter referred to in Article 905 is Chapter 6 of Title 13
of the Penal Code of 1925. In terms of Articles of the Penal
Code, these statutes are Article 871 through 978n-2. "This
chapter" of a title of the Penal Code of 1925 should not be
confused with a chapter of one of the Session Laws, the latter
being merely one Act of a Legislature, while the former is a
compilation of many such Acts.
Penal laws, outside of Chapter 6 of Title 13 of the Penal
Code, which are enforceable by game wardens, are Article
1377b, P. C., the trespass law; Article 1722a, P. C., the Water
Safety Act (on only five lakes); and Article 4075b, R.C.S.,
the Shrimp Conservation Act.[61
