months ago
After reading many of the comments
both pro and con It Is quite
evident that many approach the problem
much like they deal with religion
They base their observations
not on accepted authority but on
what I think

OPPONENTS
have charged the Supreme
Court with everything from being
Communistic to invading states
rights
But lets examine the facts
Lets sec who is acting outside the
law the Supreme Court or the segregationiststown topics
THE FIRST place to be determined
IN
mined is not the merits or
demerits of segregation Interpretation
of constitutional law Is really the
only issue That leaves no place for
what any of us think about the problemThe constitution guarantees that
there shall be no discrimination because
of race color or creed Many
people have difficulty in understanding
this highly technical language
About 50 years ago the Supreme
Court adopted the doctrine of equal
but separate facilities
Has the South abided by the spirit
of this doctrine In Its educational
system both secondary and higher
Or In any other field Involving the
races
We all know the answer

over backwards In its effort
to go slow in Invoking the U S
Constitution as it affects this problem
When the South failed to provide
equal but separate facilities
the Supreme Court was faced with
the problem of violating its oath to
uphold the U S Constitution or to
insist that the country abide by its
provisions
While all of ushave our personal
opinions concerning the Negro problem
these opinions should have
absolutely no bearing on an interpretation
of the Constitution
Maybe there is a better way to
deal with the problem Grant for the
sake of argument that segregation
is wrong Then lets propose an
amendment to the federal constitution
nullifying the constitutional
guarantee of no discrimination because
of race color or cree dIf
we disagree with the constitution
lets change It Lets not be
guilty of ignoring it or twisting it to
conform to our personal prejudices
If one area of the United States
was ignoring the particular part of
this guarantee which has to do with
creed consider the uproar we
would heart If one particular church
was treated as a second rate religion
what a howl wed hear

Righters that the Supreme
Court is invading the authority of
the states just wont hold water Our
guarantee of liberty of equal opportunity
of no discrimination because
of race color or creed has always
stemmed from the federal government
not the state If a provision
of the U S Constitution and Bill
of Rights has been violated it is
the responsibility of the federal government
to protect the citizen
The governor of Texas and other
socalled States Righters have virtually
set the state above the U S
Constitution According to their
theory if Texas wants to legalize
murder or the uncontrolled use of
narcotics then It should be allowed
to do so regardless of federal law
The guarantee of human rights isnt
something on which the federal constitution
is silent thus leaving the
problem to the states

Russians advocate desegregation
and a large group of Americans advocate

In ESA Queen Competition
Mrs Nelle Martin of Tulia is the second place winner in
a statewide queen contest of Epsilon Sigma Alpha international
business girls sorority The judge in the contest was
Bennett Cerf noted author wit and television performer on
Whats My Line panel show Mrs Martin is an active
member in the Delta Sigma chapter of ESA in Tulia In
the past she has been selected as Homecoming Queen at
TCU for the year 195354 and as Miss TCU for 195455
The coronation ceremonies for the Texas State Queen
of ESA in which Mrs Martin will participate will take place
at a dance Saturday and will highlight the activities of ESAs
Texas State Convention in Ft Worth on May 46th The
Queen and her court will be introduced by the Mayor of Ft
Worth Dr F E Garrison Flowers and other gifts will be
presented to the Queen and the two runnersup
The Queen Contest for the Convention is sponsored by
the Delta Kappa chapter of Dallas

Dies Suddenly
Funeral services for Mrs Nora
L Goodman 77 years old of 523
N Armstrong were held Sunday
afternoon at Wallace Funeral Chapel
The Rev W Nell Record pastor
of the First Baptist Church or
flclatcd Burial was in Rose Hill
cemetery
Mrs Goodman died suddenly Saturday
morning about 445 at the
home of her son Earl Goodman

She was born August 5 1878 at
Blue Rdige the daughter of the late
Mr and Mrs John Richards She
married Eugene Goodman In 1903
at Blue Ridge He died in 1945
Mrs Goodman was a member of
the First Christian church
She moved to Paducah in 1918
where she lived until 1926 when she
moved to Tulia In 1931 she returned
Paducah v and lived there until
1954 when she returned to Tulia to
make her home
Survivors include two sons Earl
and E C Goodman both of Tulia
threessisters Miss Ina Richards
Mrs Grady Havens and Miss Willie
Richards all of Paducah two brothers
Joe Richards Paducah and
Wilson Richards of Celeste four
grandchildren and several nieces
and nephews

Soil Conservation board said yesterday
that the SCS Is making available
to all farmers and homemakers
of Swisher county Arizona Cypress
trees to be used for the purpose of
wind break plantings at the special
price of 25c per tree The trees are
already rooted and are ready to
start growing
These trees according to nurserymen
should be put out in June
These trees can be secured by
making application at either the SCS

Goodner 56 years old were held
Friday afternoon at Wallace Funeral
Chapel The Rev Lewis Koer
sclman pastor of the Tulia Presbyterian
church officiated and burial
was in Rose Hill cemetery
Mr Goodner died shortly after
midnight Thursday of a lingering illness
in Swisher County hospital
where he had been a patient for
several weeks He was on leave of
absence from Douglas Aircraft Corp
in Oklahoma
He was born April 18 1900 in Cole
Okla He moved with his parents to
Swisher county in October 1905 He
married Miss Myrle Wiggington on
Sept 29 1920
Survivors include his widow one

Rural Telephone cooperative Dick
Shackelford local manager reported
that during 1955 Mid Plains has
built 7041 miles of new lines added
132 new telephones and 23 exten

Capt Nelson Borchardt has been
named commanding officer of Company
G Tulias unit of the National
Guard He succeeds Lt Travis La
Duke who recently moved to MidlandCapt Borchardt said the unit now
has approximately 70 men He also
announced that plans for the new
Tulia National Guard building have
been revised and it will be 5000
square feet larger than was originally
planned He expects construction
to get underway on the project this
summer
City Purchases Asphalt Distributor
Adopts Plans To Enlarge Plant
The city of Tulia has purchased an asphalt distributor
with which to maintain and repair the asphalt paving throughout
the city Addition of this new equipment will make it
possible for city employees to patch holes and keep in good
condition existing asphalt paving throughout the city

Wins Again
Tulia High school band has scored
another honor
It was one of three high school
bands to be a sweepstakes winner
in Region XI Interscholastic League
instrumental competition Thursday
at Canyon
Other winning school bands were
from Perryton and Phillips
Tulia band directed by Richard
Young won Division I ratings in
both concert and sight reading It
received a handsome trophy
Twentyone concert bands competedMuch paving installed in recent
years has deteriorated but the city
lacked the facilities to maintain it
Beginning Monday a systematic
paving repair program will get un
derway and all paved streets made
smooth
In other business Tuesday night
the city voted to provide the caliche
base for downtown alleys with the
property owners paying the cost of
the asphalt topping This is the
same arrangement as the city made
in connection with the recent street
paving program
The city had adopted plans for the
enlargement of the power plant
building A wing will be added to
the northeast corner of the present
building which will house the two
engines voted in the recent power

conventions throughout Texas is expected
to center over the leadership

Democratic Convention Contenders
for the position are Governor

Swisher County Divorce Rate
Tops Natl Average This Year
Disturbed over the high divorce rate in Swisher county
which at times is exceeding the national average Tulia
Ministers Association is exploring the possibiity of establishing
some means to assist couples having marital difficulties
A meeting Monday night was at
tended by local pastors representa
tives of womens groups schools
city council and the legal profession
It was decided to investigate
other studies that have been made
on the subject
Tho thinking of the group centered
around the possibility of working
with couples before marriage working
with young people and the possibility
of securing a welfare worker
who might bring separated couples
in contact with a counsellor in an
attempt to affect reconciliations before
the divorces are granted
So far this year Swisher has had
11 marriages and eight divorces
