Kansas City Mo March 8 Judge
McPherson of the federal court today
rendered a decision in the Missouri
rate cases in which he declared the
Missouu passenger and freight rate
laws of 1907 confiscatory under the
federal constitution Judge McPher
soa said the evidence in the cases
showed that under the new laws the
railroads of the state did not make a
reasonable profit He reached his de-
cision by dividing the charges to be
fixed for interstate and state traffic
in proportion to the earnings from
state and interstate business and es-
timated that six per cent would be a
fair profit Many of the roads thus
measured showed only a small profit
some more but none of them as much
as six per cent The court room was
crowded when the deision was ren-
dered

ernor Hadley in commenting on the
rate case decision handed down by
the federal court today declared that
he believed it wrong He says the
theory on which the railroad experts
find the expense basis is wrong The
attorney general declares he will take
an dppeal at once to the higher courj
and it is likely the case will go to
the supreme court of the United
States The legislature is undesirous
of reenactinglaws now but will ap
propriate any necessary sum to make
the appeal 0

train and it was reported that several
other mobs had formed in adjacent

Greenville to Celeste where he was
placed aboaid a Santa Fe passenger

Rockwall county then taken to the
