before noon Wednesday and testi-
mony in the cose was completed
Wednesday afternoon. The court,
having the murder trial of Tomas
Mar set for 9 o’clock this morning
ordered resumption of trial of the
civil suit at 8 o'clock. Disagree-
ment of attorneys over the word-
ing of the charge, however, held
up final arguments before the
jury until shortly before 11 o’-
clock this morning.
The case will be submitted to
the jury on 22 special issues.
These embody responsibility for
the accident, care in operating
the vehicles, amount of compensa-
tion and other phases of the con-
troversy. Hubert’s arm was struck
by a suck of wool on the side of
the Sprague truck, and the mem-
ber ivas so badly mangled that
amputation was necessary.

Tomas Mar, middle-aged Mexi-
can, will face a Crockett County
jury here this week on trial for
his life or freedom on a charge
of murder growing out of the fat-
al stabbing of Refugio Sanchez,
another Mexican, near the Mexi-
can suburb of Ozona on Sunday
afternoon, July 9, this year.
Mar was indicted by the grand
jury, impaneled Monday morning
hy Judge Joe Montague r.t the op-
ening of the regular September
term of court. He has been held
in the Crockett County jail with-
out bond since the slaying.
A special venire of around 65
men bus been summoned as pros-
pective jurors in the trial, report-
ing to the court this morning
when the selection of a jury got
under way. The regular petit jury
panel, which served in the trial
of civil suits early in the week,
