denied the assertion and referred to
membcra individvally if ho had men-
tioned the matter to any other party
than tho committee and then only
with referenco to tho conduct ol the
case Ho disclaimed any other inter-
est in tho cato than that attaching
lawyer and client
Col Sexton followed for tho State
no said tho removal of a judgo by
address was certainly novrt lor
which there was no established pre
cedent Although provided for by
thoorganlo law the charootcr of thfa
Legislature itself was sufficient to
provo that nothing would be done

charge of a trust committed to him
by the entire bar of Rusk and Har-
rison counties and a largo portion of
the inhabitants of tho latter county
to ask this august body to nd them
of an uiijuht unworthy in
oumbent nud an oppressive judge
Their motives weio known only to
God but his was only to perform his
duty Ho had no feeling ogalnst hta
neighbor tho defendant but was
only performing a great public dnty
Counsels object was like that of the
Legislature only tho purification of
the judiciary ot tho State This was
nota trial but simply an inquiryas to
defendants capacity for performing
the high functions of s district judgo

thero was nocriuinnl chargo against
him but if incompetent ho could bo
removed Tho ofllco ot district judge
was not hereditary it wos not a vest-
ed right but a publio trust Ool

competency was ably shown by the
counsel not that tho Judgo had not
sufficient intellect but that ho exor-
cised tho functions of his office in an
incompetent manner Ho mentioned

claimed that ho wag not endeavoring
to convict him of perjury but to
show his incompetency

claim that the Judiciary Committee

charges and tho evidence and fully
explained their differpnt bearings lie
