In many respects it is a very peculiar
case that is now engaging the attention
of the house ot representative5 Mr
Mackey the South Carolina republican
appears as claimant for a seat that was
occupied by a man who is deod Ho
does not consider in his plea the man
who is now occupying the seat In 1SS0
Mackey republican aud OConnor
democrat were the candidates for con-
gress iti tho second South Carolina dis-
trict OConnor was elected or at all
evonts he received the certificate of the
Governor of South Carolina to
that effect aud we expect ho de-
served it But Mr Mackey clamod
that he was elected that fraud had been
practiced iissuo ballots etc that ho
ought to havo the seat and thereupon
he served notice of contest This was
very early in 1881 Uefoie OConnor
had an opportunity to take his seat he
died aud there was no member from the
second district But tio Governor ot
South Carolina ordered a special elec-
tion to till the vacancy and Dibble ap
veared as tho democratic candidate
The republicans claimed there was no
vacancy ihat Maekoy had been elected
to a seat in the fortyseventh congress
in tho November previous wb n riming
against OConnorand they declined to go
to the pollsrather peferriug to abide the
contest instituted by Mackey against the
now dead OConnnor As a result Dib-
ble received over 7000 democratic
votes against some 300 that wero cast
for Mackey by republicans who persist
ed in voting despite the instructions of
leaders The Governor gave Dibble a
certillcate he went to Washington and
was seated the republicans remarking
