to f upgest that the law be bo changed
as to authorize nine jurors to render a
verdict both in criminal and civil
causes it is pleased to seo it is attract-
ing tho attention of tho legist iture.
There appears to be no necessity for
changing the constitution preliminary
to making such a change as tho con-
stitution guarantees a trial by jury
but does not prescribo how many ju
rors shall concur in tho verdict. A
verdict by nine jurors out of twelvo
woti'd still be a trial by a jury ju-t as
an iodi tmeot by nino grand jurors is
held in Texas to bo tho finding of a
lawful grand jury; notwithstf.cding
twelvo mon compose tho grand jury
Delaware and California both all w
nine jurors out of tho panel of twelve
to return a verdict; but neither of
those states changed their constitu-
tions bcfoio they enaotcd the law that
nice jurors could return a verdict and
it seems unnecessary for Texas to go
through the tedious formality of chang-
ing the constitution. Hero in Texas
six men compose a jury in the jus-
tice of tho poaoo courts.
The Nicarauga canal would aave
tho United States veasols of war from
tho long and tedious navigation
around Cape Horn and tho Oape of
Good Hopo in order to protect Cali-
fornia Oregon Washington and
Alaska fiom caval attaok. Protection
and obedienoe are correlative terms

government .that fails to proteot a
people under its authority. The Nio-

tance to San Francisco as well at

the construction of the Nicarauga

Texas should erect a monument
near tho hallowed Alamo to the im-
mortal horoes who consecrated It by
their patriotism courago and self-
sacrifice. Such a monument would
not add ono jot or tittle to tho death
less glory of that heroic baad but it
would n fleet honor on the people of
Texas and stimulato tho Texaus of
tho future to emulato thn patriotism
valor and self-sacrifice of the heroes of
tho Alamo who aro now in "fame's
eternal cam pine ground"

The News suggests that the news-
papers of Texas take consentaneously
in hand the ta-k ot raising funds to
oroct a monument to tho heroes of the
Alamo. The causo is a sacred ono.
It appeals to the heart of every Texan
whose heart is not shrivelled or be
numbed. There are ihroo hundred
thousand whito voters ia Texas each
one of whom could contribute fifty
cents witlnut missing it and these
mitts when poared in'o one heap
would amount to '150000. Many
wealthy Texans aro able to contribute
a rock to bo used in tho
nnnumont with tho namo of the
county engraved upon its surface and
let tho stato also contribute ono with
the immortal names of the 102 heroes
upon it Lt it be a nnnutnent worthy
of the imperial state of Texas and
worthy of a grateful people j;rand in
its simplicity bcautiiul in its struct-
ure and enduring in material and in.
solidity. Let it bo roared out of the
freo will offerings of tho men and wo-
rn n of Texas who aro reaping the
rich harvest from the seed sown in
pain groans wounds and hoarts
blood by tho heroes of the Alamo.

Brazos River and tho Towns Con-
tlglous Thereto.

on the "growth of great cities" the
towns and cities along the Brazos
havo a grand illustration of what they
my attain while Waco and the other
towns along the Brazos Valley may not
become London's or Paris' or even a
Constantinople or Canton they may
justly anticipate a future that can
only be attained by tho proximity of a
navigable river. It is a singular coin-
oidcooo that with lew exceptions all
tho great oities of the worle are situ
ated cither on tho sea coast or on the
edge of large navigable lakes or on
navigable rivers. Look for instance
at Glasoow it is on a navigable river
the "Clyde." Soveral miles from tht
sea from whioh point up to Giaseow
about furty two miles the river Clyde
teams with life. The whole distanoe
is covered by immense works pertain-
ing to shipbuilding and has an enor
mous population. Look at Caloutta on
the Houghly one hundred and twenty-
five miles from the sea and situated
on one of the molt difficult rivers to
navigato in the world yet we we see a
oity of nearly a million inhabi-
tants and immense wealth carry-
ing on the greatest trade
of any city in tho East. Look again
at tho Gimmes from the Bay ot Bengal
up to Ajra and evm Delhi a distitioe
ot nearly :i UO miles. See the cities

Agt.r all ti-amisn with population and
alivo with business this is natura'ly
the outcome of tho Ganes being
navigable Let us leave th'i orient
and travel to the Occident Here we

annually increasing in wealth and
population. Look at Wilmington
Del. at Ph ladelphia. Pa and other
towns along the Delaware river to
what may we attribute their pros-
perity ? "Navigation" of tho river in
fact tho number of such instances
could bo multiplied many times over
and yet the people of Texas appear to
display the nioit supremo apathy re-
garding tho improvement of their
rivers While it may cost monoy
look at what may be expected from
their improvement Whilo other cities
fljurished beside navigablo streams
must it not be a necessary consequence
tht tho territory along the valley's of
the Trinity and Brazos will become
populous and flourishing teaming with
population and abounding in wealth
of all the countries on tho
earth's surface through which there
aro rivers navigable or capable of be
in g made such none can comparo with
Ttxan in chmato and natural resour-
ce's then why should not these re-
sources be developed why should not
her population and wealth bo increas-
ed why should her rivers not be made
navigable? They have tho advantage
of all the rivers in tho east and north
in thu there ate no ice gorges; admit-
thcie are heavy freshets in certain
seasons of tho rar but what do they
amount to? They seldom last more
than about lit! and never more than
18 hours ami with an annual business
on tho Brazjb of about forty million
dollars and the Trinity nearly twico
that amount and with an exceedingly
high discriminating railroad rate
ought not tie people of Texas to
awake to '.heir own intt rests ani take
their place among tho great states and
countries of tho world?
