Sec 11-a The courts of the State of Texas

tence and to place the defendant upon ptoba-
tlion and to reimpose such sentence, under,
suth conditions as the Legislature may pre-
scibe.

Sec. 12. Governor to Fill Vacancies in State
and District Offices.-All vacancies in State
or district offices, except members of the
Legislature, shall be filled, unless otherwise
ploslded by law, by appointment of the Go-
einor, which appointment, if made during its
session, shall be with the advice and consent
of two thirds of the Senate present If made
during the recess of the Senate, the said ap-
pointee, or some other person to fill such
vacancy, shall be nominated to the Senate
during the first ten days of its session If
ejected, said office shall immediately become
vacant, and the Governor shall, without de-
lay, make further nominations until a con-
fir mation takes place. But should there he
no confirmation during the session of the
Senate, the Gosernor shall not thereafter
appoint any person to fill such vacancy who
has been rejected by the Senate, but maN
appoint some other person to fill the vacancy
until the next session of the Senate or until
the regular election in said office, should it
sooner occur Appointments to vacancies in
offices elective by the people shall only con-
tinue until the first general election there-
after.
Sec. 13. Where Governor Shall Reside.-

Sec. 14 Approval of Bills; Veto Bill Not
Returned to Become a Law.-Eery bill 11hi Ih
shall hae passed both houses of the Le4is-
lature shall be presented to the Gos init for
his approval If he approve, he shall sign it
but if he disappioe it, he shall ieturn it
with his objections to the house in which
it originated. which house shall enl er the
objections at large upon its journal, and pro-
ceed to reconsider it If. after such recon-
sider ation, two thirds of the members present
agree to pass the bill, it shall be sent with
the objections, to the other house, by which
likewise it shall be reconsidered, and if ap-
ploed by two thirds of the members of that
house, it shall become a law, but in such
cases the votes of both houses shall be de-
termined by yeas and nays, and the names
of the members voting for and against the
bill shall be entered on the journal of each
horse, respecthely If any bill shall not be
returned by the Governor with his objections
within ten days (Sundays excepted) after it
shall have been presented to him, the same
shall be a law in like manner as if he had
signed it. unless the Legislature, by its ad-
journment, present its return, in which case
it shall be a law, unless he shall file the
same, with his objections, in the office of the

Sec 16 Lieutenant Governor; Election;
Term; Powers and Duties.-There shall also
be a Lieutenant Go ei notr, u ho shall be
chosen at eeiv electon for Gosernor by the
same electors, in the ,ame manner, continue
in office for the same time and possess the
same qualifications The elector s shall dis-
tinguish for w hom they sote as Goerni and
for whom as Lieutenant Governor The Lieu-
tenant Gox ei nor shall by xirtue of his office
be President of the Senate and shall hase
when in committee of the whole, a right to
debate and ote on all questions, and when
the Senate is equally divided, to give the
casting sote In case of the death, resigna-
tion, iemosal foni office, inability or refusal
of the Governor to seie, or of his impeach-
ment or absence from the State, the Lieuten-
ant Gosei nor shall exercise the powers and
authority appertaining to the office of Go -
ernot until another be chosen at the periodi-
cal electron and be duly qualified, or until
the Goeinot, impeached absent or disabled
shall be acquitted return or his disability
