COUNCIL WILL
N0TBE HASTY
GIVES COMMITTEE SO DAYS OJT
12TH STREET FRANCHISE.
Adverse Report on Street Car Fran-
chises with Many Suggestions for
Stringent Provisions to Protect
City's Rights in Any Such Franchise.
By a unanimous vote the city
council yesterday voted anextension
of thirty days to the committee that
is looking into the matter of granting
the St. L. B. & M.t Ry the privilege
of widening their track on 12th street
to a standard gauge. The extension
of the time was asked for by Alder-
man S. L. Dworman chairman of that
committee.
The meeting was called to order by
Mayor Frederick J. Combe at three
o'clock yesterday afternoon with the
following members of the council
present: Aldermen Jas. A. Browne
S. L. Dworman S. C. Tucker W. H.
Putegnat T. Crixell and Jose Celaya
City Attorney F. W. Kibbe.
The first business after opproving
the minutes of the'preceding meeting
was the reading of a petition from H.
Grunewald requesting some action
to prevent the hackmen and draymen
from keeping their teams standing
on Twelfth street. -The petition was
referred to the street and bridge com-
mittee. Alderman Crixell then stated that
complaint had been made to him by
the proprietors of Clay's bakery that
a fruit stand had been built adjoining
his place of business at thecorner of
12 th and Levee streets and that said
building projected into the street.
Mayor Combe announced that he
would have the city engineer survey
the site and thus determine the mat-
ter as to whether the stand under dis
cussion was in the street.
The report of the committee on
street railway franchises was made
by Alderman Dworman chairman of
the committee being in substance as
follows: That all of the street fran-
chises before the city council were
found defective in various particulars
and it was recommended that all of
them be rejected.
It was further recommended that
before any such franchise be granted
by the city of Brownsville in addi-
tion to the stipulations already in-
corporated in these franchises the
following provisions be inserted:
1. That any franchise for the
construction of a street car system in
Brownsville shall specifically desig-
nate the street on which it is pro-
posed to construct a car line and
that no rights permitting the use of
the alleys be granted on the ground
that the alleys should be reserved
for the use of sewerage systems and
like municipal improvements.
2. That the grantee of such fran-
chise be found at all times in the
construction and operation of its
lines to a strict observance of all po-
existing or that may be hereafter en
acted.
3. That all tracks be maintained
on a level with the street and that the

on either side in good repair and

as the street is graded or paved and

above the surface of the street.
6. That the franchise limit the
operation of the system to tile trans-
portation of passengers.
On motion of Alderman Crixell the
clause relative to power was amend
ed so as to exclude the use of mules
or horses as motive power after
which on motion of the same mem-
ber the report was received and
the committee discharged. A mo-
tion for the adoption of the report
was also made by Alderman Crixell.
This Alderman Tucker opposed stat-
ing that as it took the committee at
least four months to make this report
the aldermen should have at least a
little time to look over the report
carefully before voting on it. On mo-
tion of Alderman Putegnat the re-
