charge his road duty by the use of such teams upon such terms
and under such conditions as the commissioners' court may prescribe.
SEC. 11. The superintendent of public roads and bridges
shall make a report under oath on blanks to be furnished by the
county to the commissioners' court at each regular term thereof,
showing an itemized account of all money belonging to the
road and bridge fund he has received, from whom received, and
what disposition he has made of same, the conditions of all roads
and bridges in the county, the name or names of all overseers
and of all persons liable to road duty who have failed or refused
to do road duty and such other matters as the court may desire,
information upon and shall make such other reports at such
time as said court may require and if any of said reports show
any name or names of any overseer or overseers or person or
persons liable to road duty who has failed or refused to do such
duty or who has disobeyed the orders of said superintendent he
shall furnish the county attorney of Bastrop County, with the
name or names of such overseer or overseers, person or persons,
and it shall be the duty of such county attorney to proceed to
prosecute such persons as provided by law; and provided further
that said superintendent shall file a copy of all of such
report made to the commissioners' court with the grand jury of
said county at each term of the district court and shall call the
attention of said grand jury particularly to the names of such
persons as have failed to do their road duty that such persons
may be indicted and tried for such offense or offenses as they
may be guilty of under the law; and provided that if said superintendent
shall make a false report to the commissioners' court
or to the grand jury, he shall be indicted and tried for such
offense or offenses as he may be guilty of under the laws of the
State of Texas and shall be immediately removed from office.
SEC. 12. The commissioners' court of said county is authorized
to purchase or hire all necessary road machinery, tools, implements,
teams and labor required to grade, drain, repair or
in any manner work and improve the roads and bridges of such
county, and said court is authorized and empowered to
make all reasonable and necessary rules, orders and regulations,
not in conflict with law, for laying out, working and otherwise
improving the public roads and bridges, and to utilize the labor
and money expended thereon, and to enforce the same. But no
change in any road shall be made that lengthens the same without
it is to the benefit of the traveling public, or for the protection
of private property, and then only upon the unanimous consent
of the commissioners' court.
SEC. 13. The superintendent of public roads and bridges
shall, under such rules and regulations as the commissioners'
*court may prescribe, employ sufficient force to enable him to do
the necessary road and bridge work in the county, having due,
regard for the condition of the county road and bridge fund and
the quality and durability of the work to be done, and shall buy
or hire such tools, teams, implements and machinery as the com-
