28 SPECIAL LAWS.
for." Returns of such election shall be made to the commissioners'
court of Nueces County, and shall be canvassed by said
court at the earliest convenient time thereafter, either at a regular
or called meeting, and, if the returns show that a majority of
the property tax-paying voters of said district voting at said
election have voted in favor of assuming said bonded indebtedness,
and in favor of levying such tax said commissioners' court
shall enter an order on its minutes declaring the result of said
election, and shall in said order pro rate to said Jarrell Common
School District No. 12 as herein created, the just proportion of
said eight thousand ($8,000.00) dollars outstanding bonded
indebtedness formerly issued by. said Petronila Common
School District No. 7 as is legally chargeable against that portion
of said Jarrell Common School District formerly belonging
to said Petronila Common School District in the following manner.
The Jarrell Common School District No. 12 as herein
created shall be liable for such portion of the eight thousand
($8,000.00) dollars outstanding bonded indebtedness as the
acreage of that portion taken from said Petronila district bears
to the entire acreage of the Petronila Common School District
as it heretofore existed, and said proportion of the eight thousand
(88,000.00) dollars bonded indebtedness after deducting
the sinking fund on hand to credit of Petronila district at the
time the debt is pro rated shall be the obligation of Jarrell
Common School District as herein created, and shall become a
legal and binding obligation against said district as if it had
been voted by said district, and said commissioners' court shall
annually levy a tax against all property in Jarrell Common
School District No. 12 as herein created, subject to taxation,
sufficient to pay the interest on and create the necessary sinking
fund to pay off and discharge said bonded indebtedness so prorated
against such district on or before its maturity, and such
amount levied and collected annually, for such purpose shall be
paid over when collected, to the Petronila Common School District
to the credit of the interest and sinking fund provided for
the liquidation of such eight thousand ($8,000.00) dollars outstanding
bonded indebtedness, as aforesaid.
SEC. 6. Jarrell Common School District No. 12 as herein
created shall have the right and power to issue additional schoolhouse
bonds, and to levy and collect a tax to pay interest thereon
and create an adequate sinking fund therefor, as provided, in the
General Laws regulating common school districts; provided, that
the tax so levied for additional bonds, together with the tax
levied to take care of the outstanding bonded indebtedness that
may be assumed, as herein provided for, shall not exceed fifty
cents on the $100.00 assessed valuation in said district; and
provided further, that said Jarrell Common School District No.
12 as herein created shall have all the rights and powers of taxation
for maintenance now granted to common school districts
under existing laws or under any laws, hereafter enacted relative
to the rights and powers of common school districts.
