1 AN ACT
2 relating to the referral by the Texas Water Development Board of
3 certain persons to another state agency, office, or division for
4 investigation or enforcement action.
5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
6 SECTION 1. Subchapter E, Chapter 6, Water Code, is amended
7 by adding Section 6.1555 to read as follows:
8 Sec. 6.1555. REFERRAL FOR INVESTIGATION OR ENFORCEMENT
9 ACTION. (a) The board, as the result of a complaint filed with the
10 board or on the board's own motion, may refer an applicant for or
11 recipient of financial .assistance from the board to the commission,
12 the state auditor's office, the Texas Rangers, or another state
13 agency, office, or division, as appropriate, for the investigation
14 of, or the initiation of an enforcement action against, the
15 _applicant or recipient.
16 (b) The executive administrator shall transmit the referral
17 to the appropriate state agency, office, or division, monitor the
18 progress of the investigation or enforcement action, and report to
19 the board on a quarterly basis.
20 SECTION 2. This Act takes effect immediately if it receives
21 a vote of two-thirds of all the members elected to each house, as
22 provided by Section 39, Article III, Texas Constitution. If this
23 Act does not receive the vote necessary for immediate effect, this
24 Act takes effect September 1, 2005.
