1 AN ACT
2 relating to providing interpreter services to certain recipients of
3 medical assistance or their parents or guardians.
4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
5 SECTION 1. Section 32.024, Human Resources Code, is amended
6 by adding Subsection (bb) to read as follows:
7 (bb) In this subsection, "deaf" and "hard of hearing" have
8 the meanings assigned by Section 81.001. Subject to the
9 availability of funds, the department shall provide interpreter
10 services as requested during the receipt of medical assistance
11 under this chapter to:
12 (1) a person receiving that assistance who is deaf or
13 hard of hearing; or
14 (2) a parent or guardian of a person receiving that
15 assistance if the parent or guardian is deaf or hard of hearing.
16 SECTION 2. If before implementing any provision of this Act
17 a state agency determines that a waiver or authorization from a
18 federal agency is necessary for implementation of that provision,
19 the agency affected by the provision shall request the waiver or
20 authorization and may delay implementing that provision until the
21 waiver or authorization is granted.
22 SECTION 3. This Act takes effect September 1, 2005.1
