1 effective June 1, 2003, is amended by amending Subsections (b),
2 (c), (d), (f), and (g) and adding Subsection (h) to read as follows:
3 (b) An individual is eligible to participate in the group
4 benefits program as provided by Subsection (a) if [the individua- :
5 (1) the individual retires under the jurisdiction of
6 the Employees Retirement System of Texas; and
7 (2) the individual:
8 (A) receives or is eligible to receive an annuity
9 under Section 814.104(a) (2) [ titlz i Dn r E, mitl ,

11 baec n] at least 10 years of eligible service credit;
12 (B) receives or is eligible to receive an annuity
13 under Chapter 803 or Section 814.104(a) (1), Government Code, has at
14 least 10 years of eligible service credit, and is at least 65 years
15 of age; or
16 (C) receives or is eligible to receive an annuity
17 that is based on [e-] eligibility under Section 814.002L [(e]
18 814.102, 814.104(b), 814.107(a), 834.101, or 839.101, Government
20 (c) An individual is eligible to participate in the group
21 benefits program as provided by Subsection (a) if [the indyividua] :
22 (1) the individual retires under the jurisdiction of
23 the Teacher Retirement System of Texas and has at least 10 years of
24 eligible service credit, including not more than five years of
25 military service credited in the Employees Retirement System of
26 Texas, or has five years of eligible service credit and is the sole
27 surviving spouse of military personnel who was killed in action;
