Section 1. WHEREAS, on July 8.
1929, the City Council of the City ox
Caldwell, Texas, pasted an ordinance
which wai approved on that date,
and which ii of record in Book 4,
Pases 125, both inclusive of the
Ordinance Records of the said City,
ordering and providing for the im-
Srovement of a portion of Main
treet in said City and sundry other
portions of streets and public places
in said City, named therein, to which
ordinance reference is here made for
all purposes and particularly with
reference to the streets or portions
thereof to be improved, the manner
of making such improvement, and
the apportionment of the cost there-
of:
Section 2. WHEREAS, on Septem-
ber 10, 1929, the City Council of said
City passed an ordinance which was
approved on that date and which is
of record in Book 4, Page 126 of the
Ordinance Records of said City, a-
warding contract for making said
improvements to Hughes Engineer-
ing Company, selecting the materials
and methods of making such im-
provements, approving contract
therefor, as executed and appropriat-
ing funds necessary to nay the City's
share of the cost of making such im-
firovement; to which ordinance it-
erance is here made for all pur-
poses: and
Section 3. WHEREAS, on Septem-
be 10, 1929. the City Council of the
City of Caldwell passed an ordin-
ance which was approved on said
date, ordering and directing the City
Engineer to prepare and submit to
the Council, a statement showing a
description of the parcels and pro-
perty abutting said portions of the
streets so ordered to be improved,
the names of the owners thereof,
with an estimate of the costs of such
improvements set opposite each par-
cel of property and the owner or
owners thereof, and such other in-
formation of the said Engineer might
deem for the benefit of the City
Council which said ordinance is of
record in Book 4, Page 127 of the
Ordinance Records of said City and
to which reference is here maae for
all purposes.
Section 4. WHEREAS, the City
Engineer has prepared said state-
ment of each or the units ordered to
be improved as aforesaid and has
furnished the same to said Council
for examination and approval; and
Section 5. WHEREAS, the Council
has examined said statements and

COUNCIL OF THE CITY OF CALD-
WELL:
1. That the Engineer's statement
showing description of the several
parcels of property abutting said
Itortions of said street ordered to be
mproved heretofore, with the names
of the owners of the said property
and the estimated costs of making
such improvements, as to oach of
said units and streets or portions
thereof, be and the same are here
now in all things adopted and ap-
proved; which Engineers statements
as so approved are as follows:
Main Street from the West line
of Fox Street to the East line of
Buck Street.
Echols Street from the West line,
of Fox Street to the East line of'
Buck Street.
Fox Street from the North line of
Main Street to the South line of
Echols Street.
Buck Street from the North line

The above streets to be known and
designated as Unit or District No. 1
to be paved 73 feet wide with One

Dallas, Texas, 8opt. 28—A sixty
ton whale, killed in July on the
Pacific Coast will be one of the many
attractions to be shown at the State
Fair of Texas, it has been announced
here by T. E. Jackson, president.
More than 6,000 gallons of formalde-
hyde were used in the embalming of
the sea monster.
This is the first whale that has
ever been brought inland on tour in
the flesh. Many whale skeletons
have been exhibited but never before
has a whale been embalmed and ¡
carried on tour. A specially built
steel railroad car has been provided
for the tour. It will be taken to its j
location on the midway in the car
upon its arrival at the State Fair.

Lady Saves Farm
Flock From Loss
Albany—That it pays to combat
disease in the poultry year has boon
brought out in the demonstration
flock of Mrs. Theron Fincher of
Shackelford county. Sore head, con-
tracted in her flock of 80 White Leg-
horns in May reduced the June pro-
duction to 18 eggs per hen, but
sanitation and vaccination and the
killing of all infected birds brought
the production back to nearly 20
eggs per hen in July. Her profits
above feed costs rose from $5.75 in
May to $28.37 in July. This is a re-
markable increase in hot weather,
according to A. C. Magee, county
agent. j

2. That a hearing shall be and is
hereby ordered to be given to all
owners of property abutting said por-
tions of said streets, and to all
others who .may claim any right,
title or interest therein or any lien
thereupon, before the City Council
of ^aid City of Caldwell, at the
Council Chamber in the City Hall
in said < ity on the 15th day of Octo-
ber. 1929, at 2 o'clock P. M. at which
time and place all owners of said
property, or all others who mt.y
cla .m any right, title or interest in
ami to the same or any lien there-
upon shall ha%'e the light to be
heard upon any question about which
they or either of them shall desire
to be heard and particularly with
reference to the question of benefits
to aid property by reason of said
improvements; and all such persons
shall be given a full and fair hearing
on all matters about which they or
either of them wish to be heard, all
objections or protests shall be filed
in writing with the City Secretary
prior to the date set for such hear-
ing but for good cause shown the
Council may permit said written pro-
tests to be filed during said hearing
or at any time before same shall be
closed. All of said persons or any
others who may desire to be heard
shall have the right to appear either
in per3on or by agent or attorney, ana
to fcubpoena witnesses and produce
testimony and the City Secretary is
here now authorized to issue
subpoenas for witnesses upon the
application of any party who desires
that same shall be done, and when
issued shall be placed in the hands
of the Chief of Police of said City
for service and said Chief of Police
is here now fully authorized, em-
powered and directed to serve said
subpoenas.
Snid heating shall be opened and
held on the date fixed above and at
the place named above and shall be
held open by the Council until all
who desire to be heard shall have
full and ample opportunity to be
hoard, an.l when, in the opinion of
said Council, a full and fair hear-
ing has been given to all who desire
to be heard, said hearing shall be
closed, and all objections and pro-
tests shall be affirmatively disposed
of at which time or any time there-
after in the discretion of the City
Council, an assessing ordinance shall
be passed levying assessments
against said respective parcels of
property and the owner or
owners thereof, for the pro-
perty owner's share of the
cost of making such improvements,
and fixing a lien on said respective
parcels of property to secure the
payment of said sums of money so
to be assessed.
3. The City Secretary is here now
authorized and directed to give
notice of the time, place and purpose
of such hearings, as aforesaiJf by
publishing the same at least three
times in a newspaper in the City of
Caldwell, Texas, of general circula-
tion in said City meeting the re-
quirements of law for official pub-
lications. the first of which publica-
tions shall appear not less that ten
days before the date set for such
, hearings, and all three publications
shall be made prior to the date of
such hearing, and said publications
when so made in accordance here-
; with, shall be binding and conclusive
, o.i all owners or all others in any
way having, claiming or asserting
any right, title or interest in and to
^said property or any lien thereupon.
4. The present condition of said
streets endangers the public health
and safety; the improvement thereof
; is being delayed pending the passage
of this ordinance and the publication
of said notice. Such facts constitute
and create an emergency and an
urgent public necessity requiring
j that all rules requiring ordinances
to be read more than one time or at
more than one meeting be dispensed
; with and said rules are here now
, dispensed with, and this ordinance
' shall take effect as an emergency
measure, immediately from and after
its passage and approval.
