WHEREAS, the contract that was entered in-
to between the Governor of the Slate ot Tex-
as of the one part, and Robert J. Walker aad T.
Butler Kii and othsrs, of the other pard on tbe
3 ISt dsy of August 1854, for tho construction of
the Minsiuippi and Pacific Railroad, under the
provisions of "an aet to provide for tho construc-
tion of the Mississippi and PaciSe Railroad" ap
proved Dec 21stl964.nas become null and void,by
the failure of tbe sm*d contractor* to make the do-
poait of three hundred thousand dollars in sold
or silvor, or evidences of debt of the State of Tex-
as; or other good par stocks, as they were required
to do by the terms of ssid aot snd tholr contraot,
and whereas by the terms of «aid aot, it is provi-
ded that in caae of such a failure, tho Governor of
said State i* authorised to enter into another con-
tract.aa near as may be in tbe terms of *aid act,
with any other company or individual*, for the
construction of said road. Now therefore notice
is hereby given, that proposals from companies or
individuals, for tbe construction of saia road in
accordance with tho provisions of said act,and the
-laws of this State, will be received at tbe office of
the Secretary of State, of this State until the first
day of May lfM5.
Said proposals must «poeifjr the time at which
tbo work shall commence, tho numborof miles to
be finished and plaeed in runniug order within
the first eighteen roooth* after the contract is en-
tered into, and each year thereafter, and at what
time the entiro road *bail ho com
with the amount proposed
Troaeury of this State according to the terms of
said act, to bo forfeited in case 50 miles of the
roadshnllnot bo completed within eighteen months

proposals must be sealed and directed to the Sec-
retary of State, Austin,Texas,and endorsed "Pro-
posals for tho construction of the Mississippi and
Paoific Railroad." A selection from said propo-
sals will be made a* early a* practicable after the
first of May, 1855, and the company or individu-
als, whose proposals may be selected, will bo re-
quired to enter into a contract in accordanoo with
tho provisions of said actand tho laws of this State
witbin one month after said first of May.
