Status of Case under Investigation for Fraud form containing
this statement: "Case Not Presented for Prosecution and No
Plan of Repayment Arranged." The worker will seek restitu-
tion for the amount of overpayments by letter to the reci-
pient.(c) If the investigative unit is successful in scheduling
repayment, the worker will be notified. The worker will seek
restitution for the amount of uncollected overpayments by
letter to the recipient.
.018. Overpayments Not Consider,'d Subject to Prosecution
for Fraud. The worker will do the following:
(1) Certify continued assistance in the correct
amount or deny the case. Notification latter and appeal pro-
cedures will be observed.
(2) Request restitution, if the amount of the overpay-
ment is greater than $10. No restitution will be sought for an
amount less than $10.
.019. Restittuton Defined. Restitution is defined as the
securing of payment from the individual in the form of a
cashier's check or money order made payable to the Texas
Department of Human Resources.
.020. Restituton Proc'edures.
(a) When department staff determine that a recipient
has been under-charged applied income because of previously
unreported or under-reported monthly income or resources,
and fraud is not indicated, the worker will pursue voluntary
restitution.
(b) Recipients or responsible relatives who notify any
department employee within 10 calendar days of changes in
income, resources, and other circumstances that affect the
amount of benefits received are nut subject to restitution,
even though the department may not be able to make the
necessary adjustment before a subsequent month's eligibility
has been provided. Also, no across-the-board conversion is
subject to restitution. Any department employee who
receives or obtains information from or about a recipient of
AFDC or Title XIX is responsible for relaying the information
immediately to the appropriate worker.
(c) The overpayment must result from the recipient's
willful withholding of information concerning income,
resources, or other circumstances that affect the amount of
grant. (Cases in which the overpayment is less than $100 are
subject to recovery procedures even if the willful misstate-
ment could result in prosecution for fraud.-
(d) Restitution is begun after the worker discusses the
situation with the recipient and sends a notification letter.
The notification letter should include an explanation of the
case action.
tel When restitution has been determined to be ap-
propriate, the worker must advise the recipient/responsible
relative of any action intended.

The Texas State Board of Examiners of Psychologists is pro-
posing Rule 400.03.00.016, which specifies the requirements
for psychologists to display their licensure and renewal
notice.
The members of the board anticipate that this new rule will
have no fiscal implications for state or local government.
Public comment on Rule .016 is invited. Persons should sub-
mit their comments in writing to Patti Smith Bizzell, execu-
tive secretary, Texas State Board of Examiners of Psy-
chologists, 5555 North Lamar, Building H, Suite 126, Austin,
Texas 78751, telephone (512) 458-3295.
This new rule is proposed under the authority of Article
4512c, Texas Civil Statutes.
.016. Display of License and Renewal Notice. Each
licensee must display the original license or an official dupli-
cate issued by the board and the current renewal notice in a
conspicuous place in the principle office where the psy-
chologist practices. Any reproduction displayed in lieu of the
above is unauthorized by the board.
