The State Banking Board is proposing to adopt Rule
055.03.04.014, permitting applicants for a state bank
charter to withhold the names of prospective officers of
the proposed bank, providing for the Board to grant a
state bank charter conditionally, and providing for the
Commissioner to approve the propsective officers
before delivering a Certificate of Authority to the pro-

officers to undue pressure and strained relationships
with their present employers, placing the applicants at
competitive disadvantage in the recruiting of talented
personnel. It is necessary that applicants for new state
bank charters be allowed free access to the personnel
market without jeopardizing the present employment
of prospective officers.
This rule will eliminate the competitive disadvantage
faced by applicants, yet provide for the qualifications of
prospective officers to be reviewed before a Certificate
of Authority is granted.
Public comment on proposed Rule 055.03.04.014 is in-
vited. Persons should submit their comments in writ-
ing to Robert E. Stewart, Commissioner, State Banking
Board, 2601 North Lamar, Austin, Texas 78705. Com-
ments will be accepted until March 15, 1976.
This rule is promulgated under the authority of Article
342-115, Texas Civil Statutes.
.014. Option to Withhold Identity of Officers. An ap-
plicant for a state bank charter may, at its option, with-
hold the identity of prospective officers until such time
as the Board rules upon the application. If an applicant
exercises the above option and the Board chooses to
grant the application, such grant will be conditional
upon the applicant's submitting resumes of qualified
proposed officers to the Board. Upon receipt of the
resumes, the Commissioner shall review the qualifica-
tions of the proposed officers, and if the Commissioner
finds the proposed officers. to be qualified, he may
deliver the Certificate of Authority pursuant to Article
342-307, Vernon's Texas Civil Statutes.
