(7) Exemption from Monthly Reporting Require-
ments. Taxpayers who remit quarterly prepayments on
or before the 15th day of the second month of each
quarter are exempted from the monthly reporting re-
quirement, provided the p'-epayment is a reasonable
estimate of the state and local tax liability for the entire
quarter. "Reasonable estimate"is defined as seventy
percent (70%) of the total amount due.

S Rules of Procedure Governing Grievances,
Hearings, and Appeals 382.13.02
The Texas State Board of Dental Examiners is propos-
ing to amend subcategory 382.13.02, Rules of Procedure
Governing Grievance.s, Hearings, and Appeals.
The changes requested in 382.13.02.026(a) are for
The requirement that exceptions be reduced to writing
in 382.13.02.029 is to prohibit errors and misunders-
The addition of the words "where applicable" in
382.13.02.047(a) would obviate pleadings unnecessary
to the determination of the matter before the Board.
The suggested amendment to 382.13.02.050 would
delete Section (a)(2) because it is believed that a sum-
mary statement of all matters to be considered for
adoption or amendment of a rule is sufficient notice to
interested parties, and that the original addition or
deletion may be changed after further study of informa-
tion received from the public.
The phrase "who have made timely requests" is con-
sidered a reasonable condition to be added in
382.13.02.050(c) and the balance of the paragraph
beginning with "In the case of substantive rules" is
* deleted because statutes govern the adoption or amend-
ment of rules by this agency. In addition to to the re-
quirements of the Texas Administrative Procedure Act,
Article 4551d and 4551d(a) require this agency to give
public notice of hearings and to submit any proposed
rule to the Attorney General for his approval as to-the
legality; and this agency is bound to consider all who
appear at open hearings and all written submissions.
Those desiring to comment upon these proposed
amendments should direct their comments in writing to
the Texas State Board of Dental Examiners, 178 South-
west Tower, 7th and Brazos, Austin, Texas 78701.
These proposed amendments are promulgated under
Article 4551d of the Revised Civil Statutes of Texas, as
.026. Presiding Officer.
(a) Hearings will be conducted by the Board or a
Hearing Officer who shall have authority to administer
oaths, to examine witnesses, and to rule upon the ad-
missibility of evidence and amendments to pleadings.
He shall have the authority to recess any hearing from
day to dayl.l or time to time.
.029. Formal Exceptions. Formal exceptions to rul-
ings of the Board or the Hearing Officer during a hear-
ing shall be unnecessary. It shall be sufficient that the
party at the time any ruling is made or sought shall
have made known to the Board or the Hearing Officer
the action which he desires.]; however, all exceptions
shall be reduced to writing by the party making
same and filed with the Board before the hearing is
closed or concluded.
.047. The Record.
(a) The record in a contested case shall includel:1
(1) all pleadings, motions, and intermediate
(2) evidence received or considered;
(3) a statement of matters officially noticed;
(4) questions and offers of proof, objections,
and rulings on them;
(5) proposed findings and exceptions;
(6) any decision, opinion, or report by the Hear-
ing Officer or the member of the Board presiding at the

considered by the Hearing Officer or members of he
agency who are involved in making the decision.
