resolution tlio bill lo which it refers
was presented for- 1113 approval on
tho 11th day :f December 18G7.
On tho 20lli of t ho same month and
before tho expiration of the ten days
after the presentation of tho bill to
tho President tho two Houses in
uc.cordanoo with u concurrent reso-
lution adopted on tho ild of D com-
ber adjourned until the Clh of Jan-
uary 18G8. Congress by their ad-
journment lli ns prevented tho re-
turn of the bill within tho timo pre-
scribed by tho Constitution and it
was thercforo left in the precise
condition in which that instrument
positively declares 11 hill shall not
be a law. If the adjournment in
December did not causo tho failure
of this bill because not such an ad
journment ns is contemplated by
tlio Constitution in the clause which
I have cited it must follow that
such was the nature of tho adjourn
inent during tho past your on the
30th of March last until tho first
Wednesday of July and from tho
20th of July until 21st of November

in tho caso of Myra Clark Gaines
vs. city of New Orleans ot. nl. was
concluded to-day. Tho appellees
raised tho question of legitimacy
alleging that tho point hud not been
decided in tho Henning's ense ns
Mrs. Gaines had not recited legiti-
macy in tho bill. Gushing for Mrs.
Gaines uontendod that tho appellees
had themselves put the legitimacy
of tho appellant in issuo by thoir
pica denying that an adulteress und
bustard could under tho laws of
Louisiana bo mudo a legatee; and
this issuo had boon decidod in the
Henning's caso. The point howev-
er was re-argued at the request of
the court. Decision hold over.
A correspondence between tho
President and Gen. Grant shows
that the President ordored Grant to
obey no orders from Stdnton nnd
Grant declines disobeying Stanton
on the ground thut Stanton is his
superior officer though tho Pres.
dent's subordinate. The President
must restrain Stanton from ordering
otherwise Grant must obey uim.-
Grant in his letters claims that
Sherman shared his views. Grant's
last letter dated yestorday to which
tho rresidont is replying to-night
claimed that the correspondence
was hurried into to day so ns to
choko off tho the President's reply
to his last letter by saying in effect
that only tho defence of his honor
as a man and a soldier induces him
to write such a letter to tho Presi
dent whom he accused of trying to
ruin him in tho estimation of Ins
countrymen. Grant admits his ac
ceptance or the secretaryship was
to prevent the President's placing
in office an obstructor of reconstruc-
tion. The President b'as held no com
munication with Stanton either
written or personal i n c e the
twelfth of August.

on tho roads while held by the gov

report takes tho ground that the
government acquires a clear title to
