4 ec. 111.001. DEFINITION OF PERSON. In this chapter:
5 1(1) "person" includes a corporation, as provided by
6 Section 312.011, Government Code; and
7 (2) the definition of "person" assigned by Section
8 311:.005, Government Code, does not apply. (New.)
9 Sec. 111.002. POWER AND AUTHORITY. To the extent not
10 preempted by federal law, the department:
11 (1) has power and authority over:
12 (A) railroads, including suburban, belt, and
13 terminal railroads;
14 r (B) public wharves, docks, piers, elevators,
15 warehouses, sh ds, tracks, and other property used in connection
16 w4 thtrailroads; and
17 (C) persons, associations, and private or
18 municipal corporations that own or operate a railroad, or a wharf,
19 IdoJ pier, elevator, warehouse, shed, track, or ot'er property
20 u sed in connection with a railroad; and
21 (2) shall govern and regulate those railroads,
22 pe sans, associations, and corporations and prevent abuses in the
23 conduct of their business. (V.A.C.S. Art. 6445, Subsec. (a).)
