by tho Court of Appeals: and the defendant dismissed
because tho complaint failed to state that tho drimo was
committed In 1010. This was proved by testimony anu
tho guilt of tho accused not denied but ho goes freo

victed of stealing a par of shot In another Texas county
was turned out by the courts because it was shown 04
appeal that tho stolen property was not -a pair of ahocs

dant showed that the house was peopled by only five

How to meet the demand for good roads is the ques-
tion that is receiving the greatest attention from state
and county officials and the public generally. It is the
question of paramount Importance on the industrial hor-
izon today.
Much wit was. last year wasted upon tho proposal to
limit the number of a times a man could get drunk in
ono year without something happening to him. Now It
turns' up again in the shape of a Berious report upon
which the Board of Estimate is asked to act outlining
a plan -for tho public treatment and cure of drunkenness
as a disease.
And "vvhy not? We have not been so successfull in
dealing with this scourage of humanity as to warrant
us in saying that some new plan may not be better. We
arrest the drunkard. We fine him which is fining his
family; or we lock him up a short time punishing them
without curing him. And tho cost is enormous.
Under the proposed system first offenders would be
released without appearing in court at all. Their fall-
ing Is the result of convlvaiallty or overestime of their
powers or mere carelessness. A warning is In sucn
cases sufficient. But if tho culprit appears in custody
again and again the certainty grows that htf 13 a vic-
tim of a diseased appetite. It is cheaper for the commu-
nity and better for him that he be cured than to be left
to continue the round between Island bar and police
court until his weakened frame succumbs. For such
offenders the new plan proposes an indeterminate sen-
tence to a hospital and industrial colony.

It must be perfectly obvious to any ope that one fly
killed is one fly less in the world to carry disease from
the stable to the food we eat. We are told that by killing
one fly we kill thousands of flies-to-be. This fly-killing
campaign probably appeals to many people in -i general
way as a good and desirable thing. We are afraid how-
ever that those most interested and who are in a posi-
tion to kill thousands of flies are not doing their sha-

and back ?ards are fly breeders. A little systematic
effort in these places will work wonders in the way of
ridding us of files Do you despise the fly in your dining
room? Doubtless you do. Yet you have a stable or a
"trash can or some other equally good breeding place In
your yard where the flies come from. Get rid of it.
Here are some rules prepared and published by the
Merchants' association of New York. Cut them out and
place them where your cook stable hoy or others may
see them constantly: Keep the flies away from the
sick especially those HI with contagious diseases. Kill
sickroom. His body is
covered with disease germs. Do not allow decaying ma-
terial of any sort to accumulate on or near your prem-
ises. All refuse which tends In any way to fermentation
such as bedding Straw paper waste and vegetable matter
should be disposed of or covered with lime or kerosene.
Screen all food. Keep all receptacles for garbage care
fully covered and-the cans cleaned or sprinkled with oil
or lime Keep all stable manure in vault or pit screened
or sprinkled with lime oil or other cheap preparations.
See that your sewage system is in good order; that It
dees not leak Is up-to-date and not exposed to flies
Pour kerosene Into the dralnB. Cover food after a meal
burn or bury all table refuse. Screon all food for Sale.
Screon all windows and doors especially the kitchen
and dining room. Burn pyrothum powder in the house
to kill flies. Don't forget If you see flies that their
breeding place is in near-by filth. It may be behind the
door under the table or in tho cuspidor. If there Is no
dirt and filth thero will bo no flies. If there is a nuisance
