A JOINT RESOLUTION
proposing an amendment to Section 28 of
Article HI of the Conatitution of the State
of Texas, so its to provide for n Board for
apportioning the state into senatorial dis-
tricts and representative districts in the
event the Legislature fails to make such
apportionment; providing for the issuance
of the necessary proclamation by the Gov-
ernor; and making an appropriation.
BE IT RESOLVED BY THE LEGISLA-
TURE OF THE STATE OF TEXAS:
Section 1. Thnt Section 28 of Article III
of the Constitution of the State of Texas
be amended so as hereafter to read as fol-
lows:
"Section 28. The Legislature shall, at its
first regular session after the publication
of each United States decennial census,
Apportion the state into senatorial and rep-
resentative districts, agreeable to the pro-
visions of Sections 25, 26, and 26-a of this
Article. In the event the Legislature shall
at any such first regular session following
tho publication of a United States decen-
nial census, fail to make such apportion-
ment, same shall bo done by the Legisln-
tive Redisricting Hoard of Toxas, which
is hereby created, and shall be composed
of five (5) members, as follows: The Lieu-
tenant Governor, the Speaker of the House
of Representatives, tho Attorney General,
tho Comptroller of Public Accounts and the
Commissioner of the General Land Office, a
majority of whom shall constitute a Quo-
rum. Said Board shall assemble in the City
of Austin within ninety (90) days after
tho final adjournment of such regular **>•-
sion. Tho Board shall, within sixty (60)
days after assembling, apportion the utate
into Bonatorial and representaMve districts,
or into senatorial or representative dis-
tricts, as tho failure of action of such Leg-
islature may make neccasary. Such n;ipor
tionment shall bo in writing an J signed by
three (3) or more of the members of the
Board duly acknowledged as tho act and
deed of such Board, and, when so executed
and filed with the Secretary of Stata, hall
have force and effect of law. Such appor-
tionment shall become effective at tho next
succeeding statewide general election. The
Supreme Court of Texas shall have juris-
diction to compel such Commission to per-
form its duties in accordance with the
provsions of this section by writ of man-
damus or other extraordinary writs con-
formable to the usnges of law. The Legis-
lature shall provide necessary funds foi
clerical and technical aid and fyr other
expenses incidental to the work of the
Board, and the Lieutenant Governor and
tho Speaker of the House of U'We^'nta-
tives shall be entitled to receive per diem
and travel expense during the Board's fis-
sion in the snme manner and amount as
they would receive white attend.n« a spe-
cial session of the Legislature, 'l'hir amend-
ment shall become effective January 1,
1951."
Sec. 2. Tho foregoing Constitutional
amendment shall be submitted to a vote of
tho qualified electors of this state *>i an
election to be held throuRhout the state
on the first Tuesday after the first Mondny
in November, A. D. 194S, at which all
ballots shall have printed thereon:
"For the amendment to Section 28, Ar-
ticle III of the Constitution of Texas pro-
viding for a Bonrd for apportionment of
tho state into senntorlnl districts mj rep-
resentative districts in the event the Leg-
islature fails to make such auport ionnv nt.
"Against the amendment to Section 28,
Articlo III of the Constitution of Texas
providing for a Board for apportionrn# tit
of the stato into senatorial districts and
representative districts in the event the
Legislature fails to make such apportion-
ment."
Each voter at such election ath-i 11 mark
out one of such clauses on the ballot, leav-
ing the clause expressing his vote on the
proposed amendment.
Sec. 3. Tho Governnor of the State of
Texas shall issue the necessary proclama-
tion for said election, and shall have the
samo published ns required by the Con-
stitution and laws of this state.
Sec. 4. The sum of Ten Thousand (S10.-
000.00) Dollars or so much thereof as m:iy
bo necessary, is hereby appropriated out of'
nny funds in the trensury af this hTate not
otherwise appropriated, to pay tht expenses
of such publication and election.

HOUSE JOINT RESOLUTION

Constitution of the State of Texas, by

whereupon without prejudice to <he right
of Hxisting creditors the portion or inter-
est set aside to each spouse shall be and
constitute a part of tho separate property
of such spouse; further providing that suco
Constitutional Amendment if adopted shail
oe belf-operative and self-executing; pro-
viding for the submission of -his Amend-
ment to the voters of this State; prescrib-
ing the form of ballot; providing foi the
proclamation and publication thereof,
BE IT RESOLVED BY THE LEGISLA-
TURE OF THE STATE OF TEXAS:
Section 1. That Section 15 of Article
XVI of tho Constitution of the State of
Texas be amended so as to read as fol-
lows:
"Section 15. All property, both real and
personal, of tho wife, owned or claimed by
.ier before marriage, and that acquired
afterward by gift, devise or descent, shall
i>e the separate property of the wife; and
laws shall bo passed more clearly defining
tho rights of the wife, in relation as well
to her separate property as that held in
common with her husband; provided that
husband and wifo, without prejudice to
pre-existing creditors, may from time to
time by written instrument as if the wife
vcre a feme sole partition between them-
selves in severalty or into equal undivided
interests all or nny part of their existing
community property, or exchange between
i hemst-ives the community Interest of one
spouse in any property for t^e community
interest of the other spouse in othor com-
munity property, whereupon the portion or
interest set aside to each spouse shall be
and constitute a part of tho separate prop-
erty of such spouse.
This Amendment is self-operative, but
laws may be passed prescribing require-
ments as to the form and manner of exe-
cution of such instruments, nnd providing
for their recordation, and for such other
reasonable requirements not inconsistent
herewith as the Legislature may from time
to time consider proper with relation to
the subject of this Amendment. Should tha
Legislature pass an Act dealing with the
subject of thiu Amendment nnd prescrib-
ing requirements as to the form and man-
ner of the execution of such instruments
and providing for their recordation and
other reasonable requirements not incon-
sistent herewith and anticipatory hereto,
such Act shall not be invalid by reason of
its anticipatory character and shall take
effect just as though this Constitutional
Amendment was in effect when the Act
was passed."
Sec. 2. The foregoing Constitutional
Amendment shall be submitted to a vote of
tho qualified electors of the State of Texas
at an election to bo held throughout the
State on tho second day of November, 1948,
at which election all voters favoring said
proposed Amendment shall write or have
printed on their ballots the words:
"FOR the Amendment to the Constitu-
tion of the State of Texas provided that
husband and wifo from time to time may
in writing partition between themselves in
severalty or into undivided interest com-
munity property existing at tho time of
partition so as to convert same into sepa-
rate property of tho resepctivo spouses
without prejudice to tho rights of pre-
existing creditors."
Those opposing said proposed Amend-
ment shall write or have printed on their
ballots the words:
"AGAINST the Amendment to tho Con-
stitution of the Stato of Texas providing
that husband and wife from time to time
may in writing partition between them-
selves in severalty or into undivided inter-
ests community property existing at tho
time of partition so as to convert same
into separate property of the respective
spouses without prejudico to tho rights of
pre-existing creditors."
Sec. 3. The Governor of the Stnte of
Texas is hereby directed to issue the neces-
sary proclamation for said election and
have same published as required by the
Constitution for amendments thereto.
