Around 190 years ago a group
of doughty souls gathered
round with smoothbore mus-
kets to argue o' ar the idea of
taxation without representa-
tion. After a prolonged and
grim struggle they won their
point at a place on the Virginia
coastline called Yorktown.

Earlier in the year the Su-
preme Court clothed in full dig-
nity of the law a rather ridi-
culous thesis, by upholding the
so-called "agency shop" clause.

This provides that unions
may get employers to sign con-
tracts which provide that if
some of the employees do not
want to belong to the union, j
that is all right. But, instead
of having their paychecks clip-
ped for union dues, they are
merely assessed for "service
fees" which the employer turns
over to the union.

This, of course, is quite tan-
tamount to having a law
whereby Protestants do not
have to belong to the Knights
of Columbus as long as their
paychecks are clipped for ser-
vice fees to go to the lodge
and obversely, Catholic" do not
have to belong to the Masons
as long as deductions are made
from their paychecks to send
"service fees" to the Mason:-;.
Obviously this hypothesis is
ridiculous but no more po than
the "agency siicp" device-

states where a right to work
law is on the statute books, they
thought this idea most ridicu-
lous. The state outlaws the
closed shop, yet the retail
clerks union felt it had the
rlffht to collect dues from all.

The Florida Supreme Court
thought otherwise, and the
union appealed.
* * *
The U. S. Supreme Court
which previously held the agen-
cy shop is valid under federal
law, decided in a state where
there is a right to work law,
the state can hold the agency
shop agreement illegal.

There is quite an object les-
son to be gained here.
* * *
While everyone looks toward
Washington to correct evils, it
is perhaps more productive to
explore what can be done on
the state and local level.

Take this case in Florida for
example. If that state did not
have a right to work law, then
the National Labor Relations
Board would have it manda-
tory that the employers deduct
service fees from all employees
not wishing to belong to a union.

But inasmuch as> Florida does
have a right to work law, the
non-union employees of Florida
can go ahead with their jobs
without having tribute exacted
from their pay checks to go into
a union treasury. Thus, in 1!)
state.4, workers are protected
against this type of extortion.
In the balance, they are subject
to it, but only because their
states have not as yet passed a
right to work law. 3t would be
nice if all states recognized
states rights are needed to
