ORDINANCE
AN ORDINANCE CLOSING THE ALLEY IN BLOCK NO. 35 IN THE TOWN OF
CLARENDON, DONLEY COUNTY, TEXAS, ACCORDING TO THE RECORDED MAP
OR PLAT THEREOF, REFERENCE TO WHICH IS HEREBY MADE FOR ALL PURPOSES;
VESTING TITLE THERETO; AND FURTHER DECLARING AN EMERGENCYBE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLARENDON:
SECTION 1: That all of the alley in Block No. 35, in the Town
of Clarendon, Donley County, Texas, according to the recorded
map or plat thereof, reference to which is hereby made for all
purposes, be and the same is hereby immediately closed and abandoned
.
SECTION 2: That title to such alley described in Section 1 hereof
shall immediately vest in Fred E. Chamberlain, Jr., who is
the fee simple owner of all property in such Block No. 35 abutting
such alley on both the Easterly side and the Westerly side
thereof, as is provided in such cases according to the laws of
the State of Texas.
SECTION 3: The fact that closing and abandoning such alley as
described in Section 1 hereof will be of no inconvenience to the
public, that such alley as described in Section 1 hereof has never
been used nor traveled by the public and it is not contemplated
that such alley as described in Section 1 hereof will ever be
used for public purposes; that such alley has always been closed
and used privately and enjoyed by adjoining and abutting land
owners on the Easterly side thereof and the Westerly side thereof
as aforesaid and by his respective predecessors in title as his
respective interests in such abutting property may appear, that
there is located individually and privately owned utility lines
and connections and other improvements in such alley which are
not owned or controlled or maintained by the City of Clarendon,
that such alley as described in Section 1 hereof should be immediately
closed and abandoned from public use and public purposes
so that the adjoining and abutting land owner as aforesaid
may use and enjoy and own the same and so that the same could be
placed on the tax rolls, creates an urgency and an emergency for
the immediate preservation of corporate purposes; therefore this
ordinance shall take effect from and after its passage and approval
as in the Charter in such cases is made and provided; and
the rule is hereby suspended requiring ordinances be read at
three meetings of the City Council.
Passed and approved, this the 21st day of June, A. D.,
1966, and such ordinance is put upon its final reading by vote
of all ayes and no nays.
