The following is tlie full text of
the decree under which Cutting
was released:
The second alcalde of the Can
ton of Bravos, in his turn, in the
penal branch, commenced to in-
stitute the present and following
case, at the petition of the 'iti-
gating party in the case of A K,
Cutting, unmarried, 40 years of
nge, a native of the state of New
York, a resident of Paso del Norte,
and editor of the weekly paper,
El Centinela, which is published
in that town, for the crime of def-
amation of character committed
against the person of Emigdio
Medina.
By virtue of tho complaint pre-
sented by the party offended the
criminal proceedings were estab-
lished and were afterwards con-
tinued before the Judge of Let-
ters of that district, in the manner
prescribed by the penal code, un-
til definite sentence was pro-
nounced, condemning the guilty
party to suffer one year of impris-
onment at hard labor, and to pay
$000, being further obligated to
render civil indemnity upon the
terms that the law prescribes di-
rect.
The defense was not satisfied
with this decision and interposed
its right of appeal. The acts in
the case came to this second
chamber on aecdnnt of the appeal
having been duly admitted.
In order to judge of the appeal
it was ordered the prisoner name
defending attorney, who should
epresent him in this second case,
and the civil part was given a
term of five days, at the end of
which they should claim their
ights in the appellate court.
A. K. Cutting refused to ap-
point a defending attorney, for
which reason the defense of his
rights was placed in charge of the
official defender, Lawyer Joaquin
Vilialva; and Emigdio Medina, al-
though he offered to be present,
did not do so, but transmitted a
document on the 10th of this
month desisting from the action lie
had been entitled to.
Although in addition to this de-
sisting act, which was at once ad-
mitted by this court, nevertheless
the court believed it to be its duty
to issue citations for the review-
previously ordered for the decision
in the present case, with full jus-
tice.
In the public audiencc which
took place on the morning of yes-
terday, El Senor, the State Pro-
secnting Attorney, asked that the
prisoner be declared guilty, and
that it be admitted that his crime
be completely purged with the im«
prisonment already suffered,
which petition was seconded by
the defender; and the act conclud-
ed with a citation which was made
to the parties concerned.
Considering, first, that Article
658 of the penal code expressly
orders that no proceedings take
place against the anthor of a libel,
defamation or calumny, unless
through the complaint of the per-
son offended, which provision is
founded upon the fact that princi-
pal party interested iu the puinsh-
mentof these crimes, is the party
offended, and as the latter has not
presented his complaint, or has
deBisted from it, therefore he re-
nounces the right which the law
gives him, and condones the of-
fence.
2. Considering that by the de-
sisting act of the party offended
by theciime, which according to
the penal code cannot officially be
tried, the^right of society to pun-
ish such offenses is not so perfect
nor comprehensive as is those of-
ftnsei in whioh «r«n tho oomplaint
but there are
fuses iu which the maimer of pro-
ceeding may be Hnjust and incon-
sistent, by reason of possibly eon-
founding the right of punishment
with Yougeaiice.
3. Considering thiit the reasons
expressed in the two preceding
considerations are made more
strong by articles 54 and 55 of the
code of penal procedure,, which
code, recognizing the right of the
offended party to desist from the
intended action does not impose
the precise obligation of contain
ing the accusation, this action re-
maining for the decision of the
judges and the tribunals in the
cases within their jurisdiction.
4. Considering that as has been
said before the offended party,
Emigdio Medina- has desisted from
the action to which he had a right
as agains', A. Iv. Cutting, and
therefore the principal motives of
these proceedings does not exist,
therefore there is not, in the judg-
ment of this court, sufficient foun
datiou to continue the case.
5. Considering, finally, that the
act of desisting on tlie part of the
party offended is conceived to bo
with the principal object of quiet-
ing the alarm consequent upon his
former complaint, un Iiin terms
clearly express, in the eight pages
of the second book; and in con-
tinuing the proceedings on a point
legally and accurately decided in
tho first instance, would bo not
only to divest that laudable prop-
osition of its effect,, but also it
would go beyond the intent claim-
ed by law and national decorum.
Under tho support of the said
disposition the Court decides, iu
the name of the justice of the state
the following propositions.
1. The act of desisting on the
part of Emigdio Medina is grant-
ed from the civil action to which
he was entitled to nguin.it A. K.
Cutting, who shall be placed im-
mediately in absolute liberty.
2. That the general prosecuting
attorney of the state, Lawyer Jose
Maria Gaudara, and the defend-
ant's'attorney, Lawyer Joaquin
Vilialva, be notified, and, after re-
turning the first book of minutes,
let tho corresponding order be
issued to the second lower judge
of Bravos for its exact fulfillment.
Let it be recorded in the archives
of the state government.

trate of tho second chamber of the
supreme tribunal of justice of the
state of Chihuahua, for this act
tried in tho appellate grade, do so
decree, order and sign before wit-
nesses. I have faith.
