FORT WORTH Texas. April 17.
Things that really will happen during the
trial of th perjury caae against the Rev.
J. Frank Non-la continue to be a matter
for oonjectur Attorneys (or the de-
fense who are willing to make any state-
mant at all as to the time likely to be
consumed in presenting the case differ
so widely that only a guess as to the
correct time is In order.
That some of the "scariest" evidence
so far adduced in the case will be brought
out tomorrow was a statement made by
O 8. Lattlmore of counsel for the defense
Wednesday after court adjourned.
Immediately after court was called to
order Wednesday morning and before the
Jury was brought Into the court room
Judge Simmons referring to the death
of J. McKenna said:
Court Adjourned for Day.
"Gentlemen that was a very sad oo-
rurrenoe the death of C. J. McKenna
the comity auditor. Ha was an appointee
of tha courts here and out of respect to
his memory I think that we Bhould ad-
journ and L therefore will adjourn this
court until tf o'clock Thursday morning."
Judge Simmons then went to the Jury
room and told the members of the Jury
of the aotlon. explaining that they would
be allowed every liberty that could possi-
bly be given to them under the clrcum-
stanoes. County Attorney John Baskln said that
as there were no courts in session and
no evidence to collect for any one on
trial he would take a rest through the
day while A. J. Clendenen special prose-
cutor for the State promised himself that
lie would "try to catch up wit hp rive
work that had been somewhat neglected
during the Norrls trial "
Eight of the attorneys for the defense
including Gillespie. Lnttimore Odell and
Iayle. met in the office of Lattlmore.

conference was held on the procedure to
be taken Thursday morning.
Will Examine Eye Witness.
It was there that Mr. Lattlmore was
Interviewed by a reporter for The Post
and In reply to tho question as to what
ixould bo done Thursday said:
"We are going to put on some wit-
nesses who will ive some of tha scariest
testimony so far brought out In this
case."
"Some of them." lie said "were eye-
witnesses to some of the most vital
transactions in connection with the case."
Asked who these witnesses were to ba
Mr. Lattlmore said that there would be
"some expert witnesses though we are
at present not at liberty to divulge the
names of any of them."

one hundred and twenty-one representa-
tive business men on board the three
launches. Panther Sunflower II and Pell-
can the most enthusiastic and strongest
trade excursion ever held from Galveston
will be started at I o'clock Thursday
morning fof Walllsville and Anahuae.
The trade evangels are carrying with
them a marine band and all sorts of re-
freshments as they will be on the water
five and one-halt hours eaoh way. Word
had been received here that quite a large
delegation of Liberty and Dayton busi-
ness men will come to Walllsville on tha
United States snag boat Trinity to Join
the excursionists at Walllsville and ac-
company them to Anahuae.

AUSTIN Texas April 17. Attorneys
for Leon Cardenas Martinet Jr. the
Mexican youth who la under death pen-
alty for the murder of Miss Emma
Brown an Austin giri near Pecos City
in West Texas laat summer today filed
with the court of criminal appeals their
formal motion for thirty days In which to
Rrepare their bill of exceptions. The case
i to be taken to the supreme court of the
United States. No action was taken on
the motion.
In presenting it for the court's con-
sideration. J. T. Cunningham of Abi-
lene one of the attorneys representing
Martinez told the court referring In par-
ticular to the matter of a mandate pur-
suant to the majority decision In the
case that the McLennan county sheriff
turn the prisoner over to the sheriff of
Reeves county for execution that he felt
that if the mandate is carried out that
Martinei would be hanged by a mob.
"I Just want to protect this man"
were his words. '1 feel that If he is
taken to Pecos City he will be banged
by a mob In less than twenty-four hours
and I don't want his blood to be on our
hands."
Answering this statement. Judge Har-
per of the court said: "If the bill of
exceptions when presented meets ahe
approval of the court the court will then
make such order as will protect the
rights of the appellant."
Previous to the presentation of this
motion there was something of a spir-
ited discussion between Judge Harper of
the court and Shelley Grover peclal
State's counsel. It had to do with the
record of this case and what had and
had not been incorporated In the docu-
ments. REHEARING ASKED
ON DIFFERENTIAL

Lewis in Behalf of Galveston
Commercial Interests.

AUBTTN. Texas. April 17.- Motion for
bearing m the celebrated Galveston dif-
ferential case was filed the supreme oourt
by Tanoey Lewis of Dallas attorney rep-
resenting the Galveston chamber of com-
merce and other defendants in error to-
day. The motion was a rather bulky
affair and set up tern assignments of
error. The most important of these set
forth that the supreme court erred In
affirming the Judgment of the trial court
and reversing and rendering that of the
court of civil appeala In the following In-
stance. Because it thereby in effect overruled
the objection to the action of the trial
court in admitting the testimony of C. C.
Oden to show what the Interstate rail rata
to Houston and Galveston and are on a
large number of articles of oommeroe and
to prove that a large per cent of these
articles were and are received in Gal-
veston at a leas rate than they were or
are received at Houston.
Because it thereby affirmed the action
of the railroad commission in effecting
and controlling and regulating Interstate
commerce originating in other States and
entering Texas by way of Galveston.
Because It failed to consider the find-
ings of fact of the oourt of civil appeals
Because it held that there was a laok
of facts to establish the connection that
the rates are unreasonable and ud&ust.
Because tt held that evidence did not
show the conditions of the Santa Fe rail-
road were similar to those on the Browns-
ville road and because it further found
that the Santa Fe did not violate the pro-
visions of article 4674 of the Revised
Statutes.
Because in affirming Judgment it neo-
essaiily held that the trial court was cor-
rect in refusing to permit witness of O.
B. Colquitt to answer certain specified
questions.
Because it found that circular No. 2177
Issued by the railroad commission with-
drawing two cents drayaga privilege at
Galveston was undue and unjust dis-
crimination against Galveston as a local-
ity and such of Us cltUsens as are Inter-
ested In the handling of cotton.
Because it did not find that the giving
of rates to Texas City that were not
awarded to Garveston was undue unrea-
sonable discrimination and violation of
article 4574 of the Revised Statutes and
because in Us statement that no objection
was made to the findings of either court
the trial court or the oourt of oiril ap-
peals it erred in not considering tho
finding ef the trial oourt as objected to.
The motion will probably be aotsd on
at an early sitting of the eoprt.

John Teague Is Charged With Death of

AUSTIN Texas April 17. Ths John
Teague murder case from this county
was submitted before the oourt of crim-
inal appeala today. Warren W. Moore
argued in behalf of the appellant. Teagtie
was convicted of killing his brother-Inlaw
John (Jest in a South Austin sa-
loon one niabx last summer. He is also
. eharcad with slaylnK George Duncan a
' deputy sheriff tfae same night.

today. The life sentence Imposed on
Andrew Harris of Washington county for
the murder of Mrs. Mary Rudolph was
affirmed. The vlotlm of this tragedy
was found with her husband John Ru-
dolph among the burned ruins of their
home In Carmine in the summer of 190.
Toe oase of Peter McMlllln from Dal-
las county was reversed and remanded.
McMillan was given eighteen years on a
charge of robbery. A man by the name
of Hamilton was the alleged victim of
this robbery. He lost a watch and chain.
Reversed and remanded also was the ap-
peal of Frank Castro of Galveston who
was convicted of manslaughter in con-
nection with the death of Nicolo Trwvlno.
Castro was under a five-year sentience.
Affirmance was the order in the case of
Jeass Payne also from Dallas who was
given two years for burglary.

been affirmed by the cuurt of criminal
appeala. He gets a life sentence.
Andre Harris was charged with murder-
ing and burning this aged couple at their
home near Carmine on the night of May
